THAT, pursuant to Standing Order 111 (1), the Senate resolves that debate on a Motion not sponsored by the Majority or Minority Party or a Committee shall be limited in the following manner: -

A maximum of three hours with not more than twenty minutes for the Mover, twenty minutes for the Majority Party Official Responder, twenty minutes for the Minority Party Official Responder and fifteen minutes for each other Senator speaking and that fifteen minutes before the time expires, the Mover shall be called upon to reply.

REGULATIONS, 2025, LEGAL NOTICE NO. 71 OF 2025

THAT AWARE THAT, the Environmental Management and Co-ordination (Strategic and Integrated Environmental Assessment and Environmental Audits) (No.2) Regulations, 2025, Legal Notice No. 71 of 2025 were tabled in the Senate on Wednesday, 9th April, 2025 and referred to the Select Committee on Delegated Legislation for consideration pursuant to Section 12(1) of the Statutory Instruments Act;

COGNIZANT THAT the Committee is required to make a report within twenty-eight sitting days after the date of referral of the instrument by the Senate pursuant to Section 15 (2) of the Statutory Instruments Act which will lapse on Thursday, 17th July, 2025;

AWARE THAT Section 15(3) of the Statutory Instruments Act, provides that by a resolution, Parliament may extend the time for consideration of a Statutory Instrument by a period not exceeding twenty-one calendar days;

NOTING that the Committee is in receipt of concerns by the public on the imposition of exorbitant fees, unjustified and punitive fee increments through the said Regulations thus compelling the Committee to further interrogate the issues;

NOW THEREFORE the Senate resolves to extend the timeline for the consideration of Environmental Management and Co-ordination (Strategic and Integrated Environmental Assessment and Environmental Audits) (No. 2) Regulations, 2025, Legal Notice No. 71 of 2025 for a further twenty-one (21) days pursuant to section 15(3) of the Statutory Instruments Act, to enable the Committee consider objections raised by the public and make its resolution on or before 7th August, 2025.

a) Could the Cabinet Secretary provide an update on the status of the solarization plan for the Wikithuki Irrigation Scheme project, as well as the reasons for any delays or challenges encountered during its implementation? …………../Appendix

c) Could the Cabinet Secretary elaborate on the overall progress of the Wikithuki Irrigation Scheme and outline the specific measures being taken to ensure the project becomes fully operational without any further delay?

Question No. 096 The Senator for Embu County (Sen. Alexander Mundigi, MP) to ask the Cabinet Secretary for Water, Sanitation and Irrigation:

a) What has occasioned the delay in commencement of the construction of Kamumu, Thuci and Thambana dams in Embu County, and could the Cabinet Secretary outline the actions taken by the Government to resolve the issue?

b) Could the Cabinet Secretary also outline the measures in place to fast-track implementation of these dam construction projects, and provide timelines for completion of each dam?

Question No. 069 The Senator for Murang’a County (Sen. Joe Nyutu, MP) to ask the Cabinet Secretary for Roads and Transport:

a) Why does the Kenya National Highways Authority (KeNHA) use privately owned motor vehicles for patrol on highways?

b) Who owns these patrol vehicles, and how are their services procured?

c) What plans does KeNHA have to acquire its own patrol vehicles, like other state corporations?

a) What is the status of the planned expansion of Malindi International Airport?

b) Could the Cabinet Secretary disclose the total acreage of land earmarked for the expansion project, and indicate the number of affected landowners?

c) What measures has the Government put in place to ensure that the affected landowners are fairly compensated, and could the Cabinet Secretary specify the number of landowners who have received compensation so far, as well as the amount paid to each?

d) What measures has the Government put in place to fast- track the compensation process, and could the Cabinet Secretary provide a timeline for full payment of all outstanding compensation amounts?

a) What is the current status of the redesign, reclassification and proposed expansion of the Eldoret– Kapsabet–Chavakali Road and the Kapsabet–Chemelil Road?

a) Could the Cabinet Secretary provide the implementation status and expected timeline for the expansion of the Nairobi–Nakuru–Eldoret corridor, particularly the dualing of the Rironi–Nakuru and Nakuru–Eldoret highways, which are critical in easing congestion along the Northern Corridor?

b) Could the Cabinet Secretary indicate the identity of the contractor for the projects as well as the funding arrangements?

Question No. 077 The Senator for Machakos County (Sen. Agnes Kavindu, MP) to ask the Cabinet Secretary for Roads and Transport:

a) What are the reasons for the delay in completion of the Kakuku-Ekalala-Matuu Road in Machakos County, and what is the current status and projected timelines for its completion?

b) Are there any plans for the construction of a bridge to connect Thika River-Ekalala-Isyuko ya Kathini in Masinga Sub-County, Machakos County?

c) When does the Government plan to commence the reconstruction of Miu ya Ng’ang’a bridge in Masinga Sub-County, Machakos County, which was swept away by floods, and what are the projected timelines for its completion?

d) What are the budgetary allocations for these projects in the 2024/2025 financial year?

Question No. 092 The Senator for Machakos County (Sen. Agnes Kavindu, MP) to ask the Cabinet Secretary for Roads and Transport:

a) Could the Cabinet Secretary provide a status update on the upgrading to bitumen standard of the 25km Mombasa Road (Devki)-Kinanie Park/ Kinanie Leather Park Road in Machakos County, which was allocated Kshs. 1,785,779,141.98 by the Kenya Urban Roads Authority (KURA), and explain how the road works align with the contract terms and road design specifications? …………../Appendix

c) What measures has the Ministry put in place to ensure the timely completion of all currently incomplete road projects by KURA and the Kenya Rural Roads Authority (KeRRA) in Machakos County, and could the Cabinet Secretary provide respective timelines for the same?

Question No. 088 The Senator for Tharaka Nithi County (Sen. Mwenda Gataya, CBS, MP) to ask the Cabinet Secretary for Roads and Transport:

a) What criteria does the Kenya Roads Board (KRB) use to determine the allocation of the Roads Maintenance Levy Fund (RMLF) to each county?

b) Could the Cabinet Secretary explain the significant reduction in the RMLF allocation to Tharaka Nithi County from Kshs. 111,763,313.00 in the Financial Year 2023/2024 to Kshs. 70,666,390.00 in the Financial Year 2024/2025?

Question No. 093 The Senator for Nairobi City County (Sen. Edwin Sifuna, CBS, MP) to ask the Cabinet Secretary for Roads and Transport:

a) What is the current progress of works on the Riruta- Ngong Railway Line project, whose construction was commissioned in 2023?

b) Could the Cabinet Secretary provide comprehensive details on the rationale for initiating the project, including the source of funding, the design framework, feasibility studies conducted, environmental impact assessment and the economic justification supporting its implementation?

c) Could the Cabinet Secretary provide a financial and cost-benefit comparison between the proposed Riruta- Ngong Railway Line and the alternative option of dualling the Bomas-Rongai-Kiserian section of Magadi Road and the Karen-Ngong section of Ngong Road?
