THAT, the Senate notes the Report of the consultative meeting of the Executive Committee of the Forum of Parliaments of the Member States of the International Conference on the Great Lakes Region (FP-ICGLR) held in Kinshasa Democratic Republic of Congo (DRC) from 22nd to 24th January, 2025, laid on the Table of the Senate on Tuesday, 23rd September, 2025.

POLITICAL FORUM (HLPF) OF THE INTER-PARLIAMENTARY UNION (IPU)

HELD IN NEW YORK, UNITED STATES OF AMERICA (USA) ON 22ND JULY,

THAT, the Senate notes the Report of the Proceedings of the High Level Political Forum (HLPF) of the Inter-Parliamentary Union (IPU) held in New York, United States of America (USA) on 22nd July, 2025, laid on the Table of the Senate on Tuesday, 4th November, 2025.

1. 10. MOTION – PROVISION OF IFMIS REPORTS FOR COUNTY GOVERNMENTS

TO THE SENATE

(Sen. Andrew Omtatah Okoiti, MP)

THAT, AWARE that, Article 96 of the Constitution provides that the Senate represents the counties, and serves to protect their interests, determines the allocation of national revenue among counties, as provided in Article 217, and exercises oversight over national revenue allocated to the County Governments;

FURTHER AWARE THAT, in the case of The Senate, the Council of Governors and 6 others Petition No. 24 and 27 of 2029 (consolidated) 2022 KESC No. 57(KLR), the Supreme Court affirmed that the Senate’s oversight authority extents to both nationally allocated and locally generated revenue;

CONCERNED THAT, that Senators are constrained by lack of access to real time to data from the IFMIS system for the respective counties they represent, thus affecting effective oversight of County Governments;

FURTHER CONCERNED THAT, in some instances data and information presented to the Senate by the Auditor-General and the Controller of Budget are received and considered late as a result of the backlog resulting into too much information not getting properly reviewed by Senators;

NOTING THAT, as a result of unchecked financial information and systems, County Governments have continued to accumulate pending bills resulting from unplanned expenditures, unaccounted for and inflated cost of projects;

NOW THEREFORE, the Senate resolves, that the Cabinet Secretary in charge of the National Treasury shall on a monthly basis forward to the Clerk of the Senate all IFMIS transactions and reports for each County Government for onward transmission to the respective Senator for information on accountability and transparency, in order to strengthen their constitutional oversight and promote good governance in the management of public finances.

1. 11. MOTION - MAINSTREAMING GENDER PERSPECTIVES IN LEGISLATIVE

AND POLICY PROCESSES

(Sen. Veronica Maina, MP)

THAT AWARE THAT, Article 27 of the Constitution of Kenya guarantees the right to equality and freedom from discrimination, with Article 27(3) providing that women and men have the right to equal treatment, including the right to equal opportunities in political, economic, cultural and social spheres;

FURTHER AWARE that Article 27(8) obligates the State to take legislative and other measures to redress any disadvantage suffered by individuals or groups as a result of past discrimination, and to ensure that not more than two-thirds of members of elective or appointive bodies shall be of the same gender;

COGNIZANT THAT mainstreaming gender perspectives in all aspects of governance is essential to achieving inclusive development and safeguarding the

rights and welfare of all citizens, particularly women, girls and other marginalized groups;

CONCERNED THAT the integration of gender considerations remain inconsistent across the two levels of government and that legislative processes have often resulted to policies that do not adequately address gender-specific needs and realities;

NOW THEREFORE, the Senate:

a) urges Parliament, County Assemblies and their respective legislative committees to incorporate a gender analysis in the scrutiny of legislation, policies, programmes and budgets before them, including through the use of gender impact assessments and consultation with gender-focused stakeholders to ensure gender-responsive governance;

b) recommends that the National Gender and Equality Commission and the State Department for Gender develops clear guidelines and tools to support the integration of gender perspectives in legislative, policy and budgetary analysis, and ensures these are disseminated and adopted by relevant government and legislative bodies;

c) further urges the National Gender and Equality Commission and State Department for Gender to collaborate with the Kenya Law Reform Commission, and County Assembly Service Boards to build capacity for gender analysis among technical and legislative staff;

d) urges the State Department for Gender to submit to Parliament a comprehensive biannual report detailing actions taken by Ministries, Departments and Agencies to promote gender mainstreaming, key achievements, emerging challenges, and proposed interventions; and

e) resolves that the Standing Committee on Labour and Social Welfare continuously monitor the implementation of these resolutions and tables biannual report on the status of implementation.

THAT, pursuant to Standing Order 111 (1), the Senate resolves that debate on a Motion not sponsored by the Majority or Minority Party or a Committee shall be limited in the following manner: -

A maximum of three hours with not more than twenty minutes for the Mover, twenty minutes for the Majority Party Official Responder, twenty minutes for the Minority Party Official Responder and fifteen minutes for each other Senator speaking and that fifteen minutes before the time expires, the Mover shall be called upon to reply.

Question No. 075 The Senator for Kisumu County (Sen. (Prof.) Tom Ojienda, SC, MP) to ask the Cabinet Secretary for Agriculture and Livestock Development:

a) Could the Cabinet Secretary provide details on the current status of pyrethrum farming in Homa Bay County, including the number of farmers currently engaged in farming, total acreage of land under cultivation and production trends over the past five years?

b) What policy reforms is the Government considering to revitalise the pyrethrum sector in the Lake Region Economic Block, and the country generally?

c) What is the Government doing to enhance access by farmers to certified pyrethrum plantlets and extension services?

d) Could the Cabinet Secretary also provide details on the initiatives by the Government to secure guaranteed foreign markets for local pyrethrum and to enhance value addition and agro-processing generally?

Question No. 105 The Senator for Makueni County (Sen. Daniel Maanzo, EBS, MP) to ask the Cabinet Secretary for Energy and Petroleum:

a) Could the Cabinet Secretary provide a list of the rural electrification projects initiated by the National Government in Makueni County in the 2022/2023, 2023/2024 and 2024/2025 financial years, and provide a status update on each?

b) What steps has the Ministry of Energy and Petroleum taken to accelerate the implementation of rural electrification projects in Makueni County and other counties where electricity access remains below 35%?

c) What initiatives is the Government implementing to promote the adoption of solar power and other off-grid renewable energy solutions among residents of Makueni County and other arid and semi-arid areas?

Question No. 123 The Senator for Tharaka-Nithi County (Sen. Mwenda Gataya, CBS, MP) to ask the Cabinet Secretary for Energy and Petroleum:

a) What specific measures is the Government taking to address the frequent power outages affecting Tharaka University in Tharaka-Nithi County and its environs?

b) Could the Cabinet Secretary also outline the Ministry’s long-term plan to improve power supply infrastructure and ensure progressive realisation of universal electricity connectivity in the specified area as well as across Tharaka Nithi County, and indicate the projected timeline for its implementation?

Question No. 043 The Senator for Nairobi City County (Sen. Edwin Sifuna, CBS, MP) to ask the Cabinet Secretary for Lands, Public Works, Housing and Urban Development:

a) Could the Cabinet Secretary disclose the current holders of the title deeds for the parcels of land registered as –

(i) LR No. 18282 in Kasarani Constituency, which comprises 1000 plots allocated to squatters in 1989 through a Government squatter resettlement scheme; (ii) LR No. 209/4844/124 (619/33) in Makadara Constituency, which was designated for use by the Mbotela Charcoal Dealers Self Help Group; and (iii) LR No. 79/811 in Makadara Constituency, which was designated for the Buruburu Phase 5 community playing ground?

b) What is the Ministry doing to safeguard the rights of the legitimate owners of these parcels of land and to address the reported cases of fraudulent claims and encroachment in respect of the said parcels?

c) Could the Cabinet Secretary also explain how the Ministry intends to generally address the growing menace of fraudulent acquisition and encroachment of public land by private individuals and developers?

Question No. 095 The Senator for Embu County (Sen. Alexander Mundigi, MP) to ask the Cabinet Secretary for Lands, Public Works, Housing and Urban Development:

a) What is the status of the construction of Embu Modern Market, and could the Cabinet Secretary disclose the timelines for completion and operationalization of the market?

b) Could the Cabinet Secretary provide similar information on all other National Government projects for the construction of markets within Embu County, and outline the measures in place to ensure that these projects are completed on time?

a) Could the Cabinet Secretary provide the details of the parcel of land commonly referred to as Kimorori Grounds in Kenol, Maragua Constituency, including the title number, date of registration and the registered proprietor, and if the land is registered in the name of either the national or county government, state under what legal instrument or gazette notice it is so held?

b) Could the Cabinet Secretary also clarify whether the said land is free of any encumbrances, mortgages, caveats or pending litigation?
