I. THE SOCIAL PROTECTION BILL (NATIONAL

ASSEMBLY BILL NO. 12 OF 2025)

1) Notice is given that the Chairperson of the Departmental Committee on Social Protection intends to move the following amendments to the Social Protection Bill, 2025 at the Committee stage––

CLAUSE 3

THAT, Clause 3 of the Bill be amended- a) by deleting the words “all persons” wherever they appear and substituting therefor the words “persons in need”. b) in sub-clause (a) by deleting the words ‘throughout their life cycles’.

CLAUSE 6

THAT, Clause 6 of the Bill be amended by deleting the word “may” appearing immediately after the words “county government” and substituting therefor the word ‘shall”.

CLAUSE 9

THAT, Clause 9 of the Bill be amended— (a) by renumbering the existing provision as sub-clause (1);

(b) by inserting the following new sub-clause immediately after sub-clause (1);

(2) Despite sub-section (1), nothing in this Act confers upon the Board the power to perform functions that are under the mandate of other government ministries, departments, trusts or agencies.

CLAUSE 10

THAT, Clause 10 of the Bill be amended in sub-clause (1) by inserting the following new paragraph immediately after paragraph (b)— (ba) the Principal Secretary for the time being responsible for matters relating to children or their representative designated in writing;

CLAUSE 28

THAT, Clause 28 of the Bill be amended in sub-clause (3) by inserting the following new paragraph immediately after paragraph (e)—

(f) unpaid, deficient and unsupported caregivers;

CLAUSE 29

THAT, Clause 29 of the Bill be amended in paragraph (b) by inserting the following new sub-paragraph immediately after sub-paragraph (viii)—

(ix) essential drugs, personal care goods and assistive devices;

CLAUSE 31

THAT, Clause 31 of the Bill be amended in sub-clause (5) by inserting the words “within sixty days of receiving an application” immediately after the words “in writing”.

CLAUSE 33

THAT, Clause 33 of the Bill be amended by inserting the words “in the first optional instance, to the Cabinet Secretary, or ” immediately after the words “may appeal”.

2) Notice is given that the Member for Funyula (Hon. (Dr.) Ojiambo Oundo) intends to move the following amendments to the Social Protection Bill, 2025 at the Committee stage––

CLAUSE 2

THAT Clause 2 of the Bill be amended by inserting the following new definitions in their proper alphabetical sequence—

“county executive committee member” means the county executive committee member responsible for matters relating to social protection; and “sub-county committee” means a sub-county Social Protection Committee established under section 30A;

NEW CLAUSES 30A & 30B

THAT the Bill be amended by inserting the following new clauses immediately after Clause 30—

NEW CLAUSE 30A

30A. (1) Each county government shall establish a Social Protection Committee in each sub-county. Establishment of sub-county social protection committees. (2) A sub-county committee shall comprise of seven members selected through a public participation forum within the sub-county and appointed by the respective county executive committee member.

(3) A person qualifies for selection as a sub- county committee member under subsection (2) if the person—

(a) is a citizen of Kenya;

(b) is above the age of eighteen years;

(781) (c) is of sound mind;

(d) has knowledge and experience in matters relating to social protection;

(e) is a resident of the respective sub-county for a continuous period of not less than five years prior to the appointment date; and

(f) is proficient in either English or Kiswahili

(4) A sub-county committee member shall be appointed on such terms and conditions as the respective County Public Service Board shall determine.

(5) A sub-county committee member shall be appointed in writing by the county executive committee member and shall serve for a period of three years, renewable once.

(6) Each county executive committee member shall prescribe, in the regulations approved by the respective county assembly the procedure for the conduct of a public participation forum under subsection (2).

(7) A sub-county committee member shall serve on a part-time basis and shall be paid such allowances as may be determined by the county government, in consultation with the Salaries and Remuneration Commission.

(8) The sub-county committee shall regulate its own procedure in the conduct of its business and affairs.

NEW CLAUSE 30B

30B. The functions of the sub-county committee shall be to— Functions of the sub-county committee. (a) identify, assess and verify the eligibility of persons for the social protection benefit applied for;

(b) recommend to the Board the eligible applicants for the social protection benefit applied for; and

(c) continuously monitor the status of social protection programmes within the sub- county and report to the Board.

CLAUSE 31

THAT, the Bill be amended by deleting Clause 31 and substituting therefor the following new clause—

1. 31. (1) A beneficiary or a representative of a

beneficiary may apply to the Board for a social protection benefit. Application for social protection. (2) The Board shall upon receiving an application made under subsection (1), convey the application to the respective sub-county committee.

(3) The sub-county committee shall upon receiving the application, conduct an assessment to verify that the applicant is eligible for the social protection benefit applied for.

(4) Upon assessing the applicant, the sub-county committee shall advise the Board in writing whether the applicant qualifies or does not qualify for the social protection benefit applied for.

(5) If the applicant qualifies for a social protection benefit as provided for under this Act, the Board shall register the applicant as a beneficiary and render the appropriate social protection benefit.

(6) If the applicant does not qualify for a social protection benefit as provided for under this Act, the Board shall inform the applicant of the decision.

(7) The Board shall convey its decision to the applicant in writing.

II. THE VALUE ADDED TAX (AMENDMENT) BILL

Notice is given that the Leader of the Majority Party intends to move the following amendments to the Value Added Tax (Amendment) Bill, 2025 at the Committee Stage—

CLAUSE 2

THAT, the Bill be amended by deleting clause 2 and substituting therefor the following new clause— Amendment of the First Schedule to Cap. 476.

1. 2. The First Schedule to the Value Added Tax Act is

amended by deleting the proviso to paragraph 146 of Part I and substituting therefor the following proviso—

Provided that the value of such investment is not less than two billion shillings, the exemption was granted before 27th December 2024 and the exemption shall only continue to apply until 27th December, 2025.

LIMITATION OF DEBATE

The House resolved on Thursday, February 13, 2025 as follows- Limitation of Debate on Motions

THAT, each speech in a debate on any Motion, including a Special motion be limited in the following manner: A maximum of three hours with not more than twenty (20) minutes for the Mover and ten (10) minutes for each other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen (15) minutes each, and that ten (10) minutes before the expiry of the time, the Mover be called upon to reply; and that priority in speaking be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

IV.

THAT, each speech in a debate on Bills sponsored by a Committee, the Leader of the Majority Party or the Leader of the Minority Party be limited as follows:- A maximum of forty five (45) minutes for the Mover, in moving and fifteen minutes (15) in replying, a maximum of thirty (30) minutes for the Chairperson of the relevant Committee (if the Bill is not sponsored by the relevant Committee), and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen minutes (15) each (if the Bill is not sponsored by either of them); and that priority in speaking be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

THAT, each speech in a debate on Other Committee Reports, including a Report of a Joint Committee of the Houses of Parliament or any other Report submitted to the House for which limitation of time has not been specified, be limited as follows:- A maximum of two and a half hours, with not more than twenty (20) minutes for the Mover in moving and five (5) minutes for any other Member speaking, including the Leader of the Majority Party and the Leader of the Minority Party and the Chairperson of the relevant Committee (if the Committee Report is not moved by the Chairperson of the relevant Committee), and that ten (10) minutes before the expiry of the time, the Mover shall be called upon to reply; and further that priority in speaking shall be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.
