THEGAMBLINGCONTROLBILL,2023 ABillfor
ANACTofParliamenttoprovidefortheregulationof betting,casinos and other forms of gambling; authorizationofprizecompetitions and public lotteries;for the establishmentof the Gambling Regulatory Authority ofKenya;for the imposition oftaxonbettingandotherformsofgambling,and for connected purposes
ENACTEDbytheParliamentofKenya,asfollows
- 1.ThisActmaybecited as theGamblingControl Act,2023.
- 2.In thisAct,unless the context otherwiserequires—
"Authority" meanstheGambling Regulatory AuthorityofKenya establishedbysection6;
"authorized race meeting"means a race meeting in respectofwhichapermitauthorizingbookmakinghasbeen issued under this Act;
"amusement game"means a game that is played by meansofan amusementmachinewith a restrictedprize;
"amusement machine"means a machine or a device whetheroperatedelectronically,manuallyorotherwiseon whichanamusementgameisplayedexclusivelyfor or amusement machine token,and includes pool tables;
"beneficial owner"has the meaning assigned to it in the CompaniesAct;
"bet"means a wager or stakeofmoney ormoney's worth,oranyothervaluablethingbyoronbehalfofany person; agreement towager or stake by or onbehalf of any person money or a valuable thing on a horse race,fight, game,sport,lotteryor exerciseor any other event,racer contingency;
"betting premises"means premises used for the purposes of betting to which thepublic has access and whicharekeptorused,on one ormore occasions,forthe Short title.
Interpretation.
No.17of2015.
purpose of-
- (a)bets being made therein between persons resorting to the premises and the owner, occupier or keeper thereof,or any person using thepremises,or anypersonprocured oremployedbyoractingfororonbehalfof the owner,occupier,keeper or person using the premises,or of any person having the careormanagementorinanymanner conducting thebusiness thereof;or
- (b)anymoneyorvaluable thingbeingreceived byor on behalf of the owner,occupier, keeper orpersonaforesaidas or for the consideration for any assurance, undertaking,promise or agreement,express or implied,to pay or give,or for securing the paying or giving by some other person of,any money or valuable thing on any horserace,orotherrace,fight,game,sport, lottery or exercise,or any other event or contingency;
"betting transaction"includes thecollection or payment ofwinningson a bet and any transactioninwhich oneormoreofthepartiesisactingasabookmaker;
"bingo"means a game where a player marks off numbersoncards or screensas thenumbersaredrawn randomly,thewinnerbeingthefirsttomarkoff all the numbersrequired andincludesplayingby electronicmeans orbyonlinecommunication;
"Board"meanstheBoardoftheGamblingRegulatory AuthorityofKenyaconstitutedinaccordancewithsection 7ofthis Act;
"bookmaker"means a person who,whether on his carries on,whether occasionallyorregularly,thebusiness ofreceiving andnegotiatingbetsexcluding—
- (a)aperson whocarrieson,or is employed to
operateatotalisatorinrespectofwhichalicence hasbeen issued under thisAct;or
- (b)a person employed in a business that is wholly concernedwithapoolbettingschemeinrespect ofwhichalicencehasbeenissued underthisAct;
"Cabinet Secretary"means theCabinetSecretaryfor thetimebeingresponsibleformattersrelatingtogambling;
"casino"means any designated premise or part of a premise,approvedvirtualoronlineplatformorasitewhere aperson may participate in a game approved by the Authority;
"chain letter"means a scheme or an investment promising ahighrateofreturnmadeupofmoneyfrom a risk;
"Collector" means theCommissioner-General appointed under section 11 of the Kenya Revenue AuthorityAct,1995;
"coupon"in relation toa pool betting scheme or proposed pool betting scheme,includes a document connecteddesigned to assistin themakingof a betbyway ofpoolbetting;
"Director-General"means theDirector-General of the Authorityappointedundersection16;
"electronic device"means an electrical,digital, magnetic,wireless,optical,or electro-magneticdevice used in gambling;
"Fund"means theNationalLotteryFundestablished bysection44oftheNationalLotteryAct,2023;
"gambling"means theplayingofagameofchancefor prize winning and includes lotterybetting,prize competitions,andmediapromotionswithprizes;
"gambling equipment"means any software, device, instrument,including a chip,a token,a voucher or any otherinstrumentwithafixedmonetarywageringvalue usedinsteadofmoneyforthepurposeofgambling,tokens dice,counter,ticket,gamblingtable,board,box,birdoran animalusedforpurposesoforcapableofbeingusedforor inconnectionwithgamblingandincludes- No.2of1995
- a) a linked jackpot equipment;
2. (b) an electronic monitoring system including any electronic,computer,communications system or deviceusedoradapted tosendorreceivedata from a gambling equipment in relation to security,accounting,monitoring,evaluation or operationofgamblingandgamblingequipment; 3. (C) any onlinegamblingmachine;or 4. (d) partofareplacementorpartof anygambling machine equipmentorsystem;
"gambling machine"means any device which is operatedelectronicallyormechanicallyorboth electronicallyandmechanicallythatisdesignedfor
- (a)placingbetsforplayinga game of chancewhich doesnotrequire actionby aplayerotherthan the manipulation of themachine;
- (b) playingagameofchancewhichrequiresno actionbyaplayerotherthanthemanipulationof themachine;or
- (c) thepurposeofplayinga game ofchanceor a game of fixed chance and skill which mayresult in payablewinnings;
"gamblingpremises"meanspremiseswhich arekept or used,whether on one or more than one occasion,for gaming,andtowhichthepublichasormayhave accessfor theplaying thereinofagameofchance,whether thegame ofchancebe anunlawfulgameornot;
"gamblingplatform"means a system that offers a full rangeofservicesforeffectingagamblingactivity;
"gambling service"means any service that is required tofacilitate anycomponentofan activityforgamblingand maybeprovided by anintermediary;
"game ofchance"includes a game of chance and skill combinedbut doesnot include an athleticgame or sport;
"good cause"means acharitable cause or an eventfor charity;
"gross gambling revenue"means total revenue receivedfromagamblingactivitybeforeanydeductions aremade;
"horse race"includes a pony race;
"jackpot"means thehighest prize resulting froma combinationofletters,numbers,symbolsorrepresentations displayedoradvertisedinagameofchanceandpayable either fromafixedprize scheduleoraccumulates as contributions aremadetoaspecial prizepool;
"licensee"means a person issued with a licence under thisAct;
"licensed betting premises"means premises duly licensedwherebetsmaybemade andsettled;
"lottery"includes a sweepstake,a raffle and any scheme,arrangement,systemplan or device for the sale, gift,disposal or distribution of any property depending uponor as determinedbya slotora chance,whetherby throwingorcastinga dice,orbywithdrawingaticket,card, slot,numbersorfigures,orbymeansofawheel;
"lottery ticket"means any document or electronic evidenceentitlingapersontoparticipateinalottery chance;
- (a) to supplier;
- (b) toperformsmaintenanceofgamblingequipment; or
- providerofgamblingservices;
"manufacture"means to produce,import,sell, lease, make available,distribute,maintain or repair a gambling device andmayinclude-
(a)to supply;
- (b)to perform maintenance of gambling equipment;or
- (c)toprovidegamblingservices;
"National Lottery"means the national lottery establishedundersection22oftheNationalLotteryAct, 2023;
"odd"means a gambling chance;
"online bookmaker"means a person who carries on anyformofbettingbymeansofremotecommunications, including virtual games,virtual sports as well as other forms ofgambling;
"online gambling"means any form of gambling in which persons participatebythe use of remote communicationandontheinternet;
"personncludes aartnership,association,trust,ra juristicpersonestablishedbyoperationofanyotherlaw;
"poolbetting"meansthemakingofbets,other than betsmadebymeans of totalisator,whether thebets are orbeashareof,orbedeterminedbyreferenceto,thestake
madeon thesystemknownasa fixedoddsbetting or otherwise,byanumber ofpersons on terms that the moneypaidor agreed tobepaid by thosepersons;
"pool betting scheme"means a scheme involving the receivingornegotiatingofbetsmadebywayofpool betting;
"prize"means theprizeawardedtoawinnerofa
lotteryor aprizepromotion;
"punter"means a personwhois in possession of a valid ticketorotherkindofvalidreceiptissuedbya licenseerelating togambling;
"race meeting"means a gathering of the public or of membersof anassociationof persons towatchan authorized horserace or any otherrelatedrace;
"record"includes any book, account, document,paper orothersourceofinformationcompiled,recorded,storedin writtenformoronmicrofilm,orbyelectronicprocess,or in any othermatter orby any othermeans;
"reporting institution"has the meaning assigned to it in theProceedsof Crime andAnti-MoneyLaunderingAct;

"security"means any deposit provided as security under thisAct;
"slot machine"means any mechanical,electrical or other device,contrivance or machine that is metered and which is able to record history of play,which,upon insertion of a coin,token or similar object,or upon payment of any consideration,is available to play or operate,theplayor operationofwhich,whetherbyreason oftheskilloftheoperatorinplayingagamblinggame whichispresentedforplaybythemachineorapplication oftheelementof chance,orboth,may deliver or entitlethe personplayingor operating themachine toreceive cash, premiums,merchandise,tokens or anything of value, whetherthepayoffismade automaticallyfromthemachine orin any other manner;
""stake"means money or money'sworth that a player mayrisktomake abetorbuyintoagamblinggame;
"testing agent"means a person licensed under this Act totestand calibrate gambling machines,equipment or devices;
"ticket"inrelation to anylotteryorgame ofchance, includesanywrittenorelectronicdocument evidencingthe claimofapersontoparticipateinalotteryoragameof chance;
"totalisator"means an instrument,a machine,a contrivance,or a scheme for enabling any number of persons tomake betson anyeventor contingency and includesadeviceshowingthenumberandamountofbets stakedin arace;and
"Tribunalmeans the GamblingAppeals Tribunal establishedinsection88.
3.Theobjects andpurposeof thisActisto
- (a) provideaframeworkforregulationandcontrolof gambling activities;
- b) authorise some gambling activities andprohibit therest asunlawfulgambling;
- ()promote thedevelopment of aresponsible

gambling industry;
- d) minimizesocial harm associatedwithgambling;
2. e ensure integrity and fairness in licensed gambling activities;and 3. providefortheestablishmentofmechanismsfor resolution of disputesrelatingtogambling.
PARTII-FUNCTIONSOFTHENATIONAL GOVERNMENTANDCOUNTYGOVERNMENTS
- 4.(1)TheNational Governmentshall
- a establishpolicies,normsand standardsfor the conductof betting,lotteries,casinos and other forms of gambling;
- (b) regulate thegambling industryin accordancewith Act;
- C) licencegamblingactivitiesincludingonline gamblingin accordancewiththisAct;
- d licencenational lotteries;
- e conduct security checks,vetting and due diligence inrespect ofgambling activities;
- enforcecompliancewiththisAct;
- g) conduct tanti-moneylaunderingrisk-based inspections and inspections to combat financing of terrorism throughcasinos and anyotherforms ofgambling;
- h pursuanttosections2A,36A,36Band36Cofthe ProceedsofCrimeandtheAnti-money Laundering Act,2009,regulate and supervise the reportinginstitutionslicensedunderthisAct;
- (i) provide capacity building and technical assistancetocountygovernments;and
- (! perform any other function as maybe prescribed under this Act or anyother writtenlaw.
- (2)In the discharge of itsmandate under subsection
Functions of the National Government.
No.9of2009
- (1),the Authorityshall collaboratewith 1county governments andcounty gamblingregulatory authorities in the discharge of functionsrelating to betting,lotteries, casinos and other forms of gambling.
- 5.Acountygovernment shall—
- a) implementand ensurecompliancetothisAct;
- (b) issuetradepermitsforgamblingpremises;
- ? implementpolicystandardsand norms of gamblingwithinitsjurisdiction;and
- (d) ensure periodicmonitoringandevaluationof betting.lotteriesandgamingtradepermitsissued by countygovernments;
- e handlecomplaints andfacilitate arbitration;and
- f perform suchotherfunctionsas areincidental to theexerciseofanyorallofthecounty government functions provided for under this Act.
PARTIII-ESTABLISHMENTOFTHEGAMBLING REGULATORYAUTHORITYOFKENYA
- 6.(1)Thereisestablished anAuthority tobeknown as theGamblingRegulatoryAuthorityofKenya.
- (2)The Authorityshallbeabodycorporatewith perpetual succession and a common seal and shall,in its corporatenamebecapableof
- a) taking,purchasing or otherwise acquiring, holding,charging and disposing of movable and immovableproperty;
- b borrowing money;
- C enteringinto contracts;
- d suing and being sued;and
- e doingorperformingall such otheractsnecessary for theperformanceofitsfunctionsunder this Actwhichmaybelawfullydoneorperformedby a body corporate.
- (3)TheAuthorityshall be thesuccessorof theBetting ControlandLicensingBoardestablishedundersection3of

(4)Theheadquartersof theAuthorityshall bein Nairobi,but theAuthority mayestablish offices at such other places in Kenya as may be necessary for the executionofitsmandate.
7.(1)Themanagement of theAuthority shallvest ina Boardwhichshall consistof
- (a)a Chairperson who shall be appointed by the President;
- (b) the PrincipalSecretaryin theministry for the time being responsible for matters relating to gambling or a representative designated in writing;
- the Principal Secretaryin theministry for the timebeingresponsiblefortheNationalTreasury orarepresentative designatedinwriting;
- (d) theAttorney-Generalorarepresentative designatedinwriting
- e) threepersons,notbeingpublicofficers,appointed by the Cabinet Secretary,being persons with background in finance,law,betting and lotteries orbusinessmanagement,provided that
- (ione shall representpersons with disabilities; and
(i)one shall representfaith-based organizations;
- onepersonnominatedbythe Councilof Governors and appointedby CabinetSecretary; and
- (g) theDirector-Generalwhoshallbeanexofficio member.
(2)TheappointmentoftheChairpersonandmembers appointed under subsection(1)(a),(e)and (f) shall be by name andnoticein the Gazette.
(3)The Chairperson and members of the Board appointed under subsection (1)(a),(e) and (f) shall hold officeforatermofthreeyearsandshallbeeligibleforre- Cap.131.

appointmentforonefurthertermofthreeyearsbasedon satisfactoryperformance.
(4)Inappointing themembersof the Boardunder subsection(1)(e),the CabinetSecretary shall-
- (a)ensurethatnotmorethantwo-thirdsofthemembers are of the samegender;
- (b)observe theprincipleofregional and ethnicbalance; and
- (c)havedueregard totheprincipleoffaircompetition andmeritasthebasisforthe appointments.
(5)Themembersof theBoard shall beappointed at differenttimessothattherespectiveexpirydatesoftheir termsofofficefallatdifferenttimes.
8.(1)Aperson shallbe qualifiedfor appointment as the ChairpersonoramemberoftheBoard,iftheperson
- (a) isaKenyancitizen;
- (b) holds a universitydegreefrom auniversity recognizedinKenya;
- hasaminimum oftenyearsworking experience inarelevantfield;
- (d) wasnota director,employee,or shareholder ofa gambling operatorin theprecedingfiveyears;
- e meets therequirements of Chapter Sixof the Constitution;and
- hassubmittedtotheCabinetSecretaryawritten declarationstatingthatthepersondoesnothave anyinterestsinthegamblingsectoror aninterest inabusinessorenterprisethatmayconflictor interfere with theproperperformanceof the dutiesofamemberoftheBoard.
(2)Apersonshallnotbeappointed asa Chairperson ormemberoftheBoardiftheperson
- (a)is an undischarged bankrupt;
- (b) has beenconvictedofacriminaloffence and sentenced toimprisonmentforatermexceeding sixmonthswithout the optionofafine;

- at thetimeof appointmentholds apolitical office;
- (d) )haspreviouslybeenremovedfromapublicoffice onaccountofmisconductoranyotherlawful reasons;or
- e inthelasttwelvemonthsimmediatelypreceding the appointment,hadpersonaldirectorindirect commercialinterestinthesectorregulatedunder thisAct.
Vacancy inthe Board.
- 9.(1)Theofficeof theChairpersonoramemberof theBoardappointed under section7(1)(a),(e) and(f) shall becomevacantiftheholder-
- (a) dies;
- (b) resignsfromofficebynoticeinwriting,incase of the Chairperson,to thePresident and,incaseofa member,to the CabinetSecretary;
- C isconvictedof an offenceand sentenced to imprisonmentforaterm exceedingsixmonths;
- (d) has been absentfrom three consecutivemeetings of theBoardwithout a notice to the Chairperson; or
- (e)is removed in accordance with subsection(2).
- (2)AmemberoftheBoardmayberemovedfrom office for-
- (a)violation of the Constitution or any other law;
- (b) grossmisconduct,whetherin theperformance of thefunctionsoftheofficeofamemberor otherwise;
- physicalormentalincapacitytoperformthe functionsofthe officeofamember;
- (d) incompetence;or
- (e) bankruptcy.
- (3)The Cabinet Secretary shall ensure that any vacancyin theBoardis filled assoon aspracticable in accordancewiththeprovisionsoftheAct.
- 10.TheAuthorityshall
- a develop standards and norms for betting, lotteries,casinos and otherforms ofgambling;

- (C) issuelicencesfor gambling activitiesprescribed under thisAct;
- (d) developpoliciesforplacingofbetforbetting, lotteriesandgambling thatincludea savings componentforsocial healthinsuranceor social retirement benefit;
- e monitortheimplementationofgamblingpolicies atthenational andcountylevel;
- establish andmaintainaregisterofallgambling machines and devices,and otherrelevant data on licensedgamblingactivities;
- g) conduct securitychecks, vetting ganddue diligence in respect of gamblingactivities, licensees,theirshareholders,directors and staff;
- (h) establishanelectroniccentralreal timegambling monitoring system tomonitor compliancewith regulatoryrequirements;
- (i) monitor socio-economicpatternsof gambling activitiesatthenationaland countylevel includingtoundertakeresearchandidentify factors relating to,and patterns,causes and consequences of-
- (i) the socio-economicimpactofgambling;
- (i) addictiveorcompulsivegambling;and
- (ii) anyothermatter thatisrelevantto thegambling sector;
- coordinateresearchand surveysrelating to the gambling industry;
- k monitor andalleviate illegalcross border gambling activities in collaboration with county governments;
- advisecountygovernmentsonmattersrelatingto theregulationofgamblingactivities;
- (m)1 receive andmake determination on complaints fromcompanies andthe publiconmatters pertaining to games ofchance;and
- (n)establish programmes toimprove the capacity of
countygovernmentsonmattersrelatingtothe regulation ofgambling activities;and
- performanyotherfunctionsconferredbythisAct oranyotherwrittenlaw.
11.(1) The Cabinet Secretary shall,in consultation withtheAuthority,prescribeguidelinesofpracticeonthe manner in which facilities for gambling are operated, whetherbytheholder ofa licenceunder thisActorby any otherperson.
(2)A guideline issuedunder subsection(1) shall describearrangements thatshouldbemadebyaperson providingfacilitiesforgamblingforthepurposesof
- (a) ensuringthatgamblingisconductedinafair andopenway;
- (b) protecting children and other vulnerable personsfrombeingharmedorexploitedby gambling;
- (c) makingassistanceavailable topersonswho areormaybeaffectedbyproblemsrelatedto gambling;
- (e) information anddataprotectioninaccordance with theDataProtectionAct;
- (d) protectingofvulnerablegamblers;
- (± onlinepaymentprotection;
- (h) ethical andresponsible marketing;
- (g) creation of secure online gambling environment;
- (i) safety measures against criminal activities, anti-moneylaunderingand terrorism;and
- () public awareness and education campaigns.
(3)The Cabinet Secretary may,in consultation with the Authority,review the guidelines issued under this section.
(4)Beforeissuingorrevisingtheguidelinesunderthis section,theCabinet Secretaryand the Authorityshall Gambling operation Guidelines.

- 12.(1)TheBoardshall have allpowersnecessaryfor the properperformance ofitsfunctions under thisAct.
- (2)Withoutprejudice to thegenerality ofsubsection (1),theBoard shall havepower to——
- (a) control,supervise and administer theassetsofthe Authority in such manner as best promotes the purposeforwhich theAuthorityis established;
- b) receivea anygrants,gifts,donations endowmentsmadetotheAuthorityandmake disbursements therefrominaccordancewith the provisions ofthisAct;
- conduct such investigations asmaybenecessary for the enforcement ofthisAct;
- (d) approve theopening,operationandclosingofthe bankaccountsoftheAuthoritywith the approvalof theNational Treasury;
- e conduct such investigations asmaybenecessary for theimplementation oftheAct;
- ( inquire into any complaint against a licensee;and
- g) undertakeany activitynecessaryforthe fulfilmentofanyofthefunctionsoftheBoard.
- 13.(1)Theprocedure for the conduct of thebusiness andaffairsoftheBoardshallbeasprovidedintheFirst Schedule.
- (2)Subject to the First Schedule,the Board shall

16.(1)There shall be a Director-General of the Authoritywhoshall be appointedby theBoard through an open,transparentand competitive process on such terms and conditions as the Board may,on the advice of the Salaries andRemuneration Commission,determine.
(2)Apersonshallbequalifiedforappointmentasthe Director-Generalif theperson
- (a)is a citizen of Kenya;
- (b) holdsadegreefromauniversityrecognizedin Kenya;
- (c) has at least ten years'experiencein senior managementinapublicoraprivateinstitution; and
- (d) satisfies therequirementsofChapterSixof the Constitution.
- (3)TheDirector-General shall be
- (a)the ChiefExecutive Officer oftheAuthority;
- (b) the custodian ofall therecords of theAuthority;
- (C) responsible for-
- (i) theday-to-daymanagementof theaffairsand staff of theAuthority;
- (i) facilitating, coordinating and ensuring executionof themandateof theAuthority;
- (iii) the management and maintenanceof efficiencyofthestaffoftheAuthority;
- (iv)the execution of decisions oftheBoard;
- V preparing and submitting for approval,by the Board,programmes of work for the
- achievementofthemandateofthe Authority;and
- (vi) the performance of such other duties as may be assignedby theBoardor anywrittenlaw.
- (4)The Director-General shall serve fora termof threeyearsandshallbeeligibleforre-appointmentforone further term of threeyears.
- 17.(1) TheDirector-General may be removed from officebytheBoardinaccordancewith thetermsand conditionsofservicefor-
- (a)gross misconduct or misbehavior;
- (b)bankruptcy;
- (c)incompetence orneglect of duty;
- (d)violationof theConstitutionor any otherwritten law;or
- (e)inabilitytoperformthefunctionsofofficeby reasonofphysical ormental incapacity.
- (2)BeforetheDirector Generalisremovedunder subsection(1),theDirector-General shall begiven—
- (a)sufficientnoticeof theallegationsmade against him or her; and
- (b)an opportunity to present hisor her defence against the allegations.
- 18.(1) The Authority shall competitivelyrecruita personqualified,intermsofthelawgoverningthepractice ofpublicsecretariesinKenya,toserveastheSecretaryto the Board.
- (2) TheSecretarytotheBoardshall
- (a) provideguidanceto theBoardon theBoard's duties,responsibilities andpowers;
- (b) ensure thatBoard follows its procedures and complieswiththerespectivelawsand

- (h) perform suchother duties astheBoardmay direct.
19.The Authoritymay appoint such numberof professional,technical and administrative staff for the Authority asitmay considernecessaryfor the dischargeof its functions,on such terms and conditions as the Board may determine,on the adviceof theSalariesand Remuneration Commission.
20.TheBoardmaybyresolution,either generallyor in anyparticular case,delegate toanycommitteeofthe Boardortoanymember,officer,employeeoragentofthe Board,the exerciseofanyof thepowers or the performanceofanyofthefunctionsordutiesoftheBoard underthisActorunder anyotherwrittenlaw.
21.(1)Thecommon seal of the Authority shall be keptinthecustodyoftheDirector-Generalorsuchother person as the Board,may direct and shall not be used exceptupontheorderoftheBoard.
(2)The common sealof theAuthority shall be authenticatedbythesignatureoftheChairpersonof the BoardandoftheDirector-General:

- b themoneyspaidby theoperatoroftheNational Lotteryunder section 43(1)(c)of theNational LotteryAct,2023;
- ? suchmoniesasmayaccrue toorvestinthe Authorityinthecourseoftheexerciseofits powersor theperformanceofitsfunctionsunder thisAct;
- (d)such license fees,charges and penalties as may be prescribed and approvedbytheCabinetSecretary inconsultationwiththeCabinetSecretary responsible for National Treasury;
- e interestfromtheinvestmentofmoneystandingto thecreditoftheAuthority;and
- allmoniesfromanyothersourceprovidedfor, donated orlenttotheAuthority.
- 23.The financial year of the Authority shall be theFinancial year. periodoftwelvemonthsendingonthe thirtiethJunein everyyear.
- 24.(1)At least three months before the Annualestimates. commencement of each financial year,the Board shall cause to be prepared estimates of the revenue and expenditureoftheBoardofthatyear.
- (2)The annualestimatesshallmakeprovisionsforall estimatedexpenditureoftheBoardforthefinancialyear concerned,andinparticularshall providefor the
(a)paymentof salaries,allowances and other chargesin Fundsofthe Authority.
respectofthestaffoftheBoard;
- (b)paymentofpensions,gratuitiesandotherchargesin respectofformerstaffoftheBoard;
- (c)proper maintenance of thebuildings and groundsof the Board;
- (d)maintenance,repairandreplacement ofthe equipment andotherpropertyoftheBoard;
- (e)paymentofallowancesofthemembersoftheBoard and themembersoftheBoard;and
- (f)creation ofsuch reservefundstomeetfutureor contingentliabilitiesinrespectofretirement benefits,insurance,replacement of buildings or equipment,orinrespectofsuchothermattersasthe Board may deemfit.
25.(1)TheAuthority shall cause tobekept allproper books and records of accounts relating to the income, expenditure,assets andliabilitiesoftheAuthority.
(2)Theaccountsofthe Authority shallbeprepared and audited in accordance with the Public Finance ManagementAct,2012andPublicAuditAct,2015.
26.1) The Authority shall prepare quarterly and annual financial and non-financialreports in a format prescribed bythePublicSector AccountingStandards Boardandsubmitthesame totheNationalTreasurywith copiestotheControllerofBudgetand theCommissionon Revenue Allocation.
(2)The Authority shall continuously and on a regular basismonitor andreporton itsperformance andon the performanceof allofitslicenseesonaquarterlybasis,with asummaryofperformancereportedthroughAuthority's annualreportonthebasisofaclearoutcome-based performanceframeworkdeveloped bytheNational Government.

PARTIV-LICENCESANDPERMITS
28.(1)Apersonshallnotofferanygamblingactivity orserviceunlesstheactivityorserviceislicensedunder this Act.
(2)The Authority shall issue gambling licences under thisActwithrespect to——
- (a)a public gambling for conducting a table game and operatingaslotmachine;
- (b) the national lottery;
- ? a bookmaking;
- (d) licensingof on-thecourse andoff-thecourse totalisators;
- (e) a prize competition;
- () a bingo;
- (g) apoolbetting scheme;
- (h) publiclotteries as under section50(2);
- (i) an onlinegambling;
- () gambling equipment and devicemanufacture or assembling;
- (k) gambling equipmentanddevicesaleor distribution;
- 1) gamblingequipmenttesting;
- (m)provisionofanygamblingsoftwareorplatform;
- (n) gamblingequipmentrepair and servicing;
- o) key gambling employees;
- p accreditation licencefor a person engagedinnon-
- (q)all media promotions with prizes and prize

(3)TheCabinetSecretary shall inconsultationwith the Authority,makeregulations for the classification of licensesissued under thisAct.
(4)In this section,"gambling employee"means a personwhoisemployedor authorized,tomakeadecision that regulates the operations of a casino,bookmaker, lottery,racecourseor anyotherformofgambling.
29.A person shall not be licensed to offer any gamblingorbettingactivityunderthisActunlessthat person-
- (a)is abody corporateinwhicha minimum of thirty per centof shares are held byKenyan citizens; and
- (b) maintainsan accountwith an authorizedfinancial institutionregisteredinKenya intowhichit pays allmoniesrelating tothelicensed gamblingand lottery activity.
- 30.(1)An application for a licence shall be made in theprescribedform and,be accompaniedby
- (a)t theapplicationfeeprescribed bytheCabinet Secretaryinregulations;
- (b) sufficientevidencetoshowthatthe applicantisin possession of,or commands the prescribed gambling capital;
- ? securitybywayofsuchinsurancebondorbank guarantee as security asmaybeprescribed under theActorregulations;
- d) informationfromtheapplicantoftheproximity of theintendedpremisetoalearninginstitution;
- (e) declarations as provided for in the Second Schedule;
- (± such other informationas it mayconsider necessarytoenabletheAuthoritytodetermine theapplication;and

- (2)TheAuthorityshallvetallapplications fora licence under this Act.
- (3) The Authority shall,in determining whether an applicantissuitabletohold alicenceorpermitunder this Act,consider,in relation to the body corporate and its directors,asapplicable——
- (a)thefinancial status or solvency of the person;
- (b) theeducationalorother rqualificationsor experienceoftheapplicanthavingregard tothe nature of thefunctionswhich,if the applicationis granted,theperson shall perform;
- thestatusof anyotherlicenceorapprovalgranted
- (4)Withoutprejudice to thegeneralityof subsection (1),theAuthority may,in considering whether an applicant is fit and proper-
- (a)take intoaccountwhether the applicant or the directorsofthebodycorporate
- (i has contravenedanylawin Kenyaor elsewheredesignedfortheprotectionof membersofthepublic againstfinancial loss duetodishonesty, incompetence or malpracticebypersons sengaged in transactingwithmarketable securities;
- (ii)wasadirectorofalicensedpersonwhohas beenliquidatedorisunderliquidationor statutorymanagement;
- (ii) has taken part in any business practice which,isproventobefraudulent,prejudicial tothe market or public interest,or was otherwiseimproper,whichwouldotherwise discredit theapplicant'smethodsof conducting business;
- (iv)has takenpart or hasbeen associated with anybusinesspracticewhich casts doubt on the competenceor soundness ofjudgment of
that applicant;or
- V hasactedinsuchamannerastocastdoubt ontheapplicant'scompetenceandsoundness of judgment;
- (b)takeintoaccount anyinformationin the possessionof theAuthority,whetherprovidedby the applicant ornot,relating to——
- (i)any person who is to be employed by, associatedwith,orwhoshallbeactingforor onbehalfof,the applicantfor thepurposes ofa regulated activity,including an agent; and
- (i)where the applicant is a companyin agroup ofcompanies,any other company in the samegroupofcompanies,or any substantial shareholderorkeypersonnel of the company oranycompanyreferredtounderthis subparagraph;
- ? takeintoaccountwhethertheapplicanthas establishedeffectiveinternalcontrolprocedures and risk management systems to ensure its compliancewith allapplicableregulatory requirements;and
- (d) haveregardtothestateofaffairsofanyother business which the applicant carries on or purportstocarryon.
- (5)The Authority shall give the applicant an opportunitytobeheardbeforedeterminingwhether the applicantisfitandproperforthepurposes of thisAct.
(6)Apersonwhoknowinglymakesafalsestatement or declaration in an application for,or a renewal or variationof,alicenceorpermit commits anoffence and shall,uponconviction,beliableto afinenotexceedingone million shillings or to imprisonment for a term not exceedingoneyear,ortoboth.
(7)For the purposes of this section,"group of companies"means any two or more companies,one of whichistheholdingcompanyoftheothers.
(8)The Authority may grant a licence upon considering all therequirementsunder thissection.
(9)The Authorityshallwithinfourteendaysof issuanceofalicenseunderthissection,transmitacopyof thelicence to therelevantcountygovernment.
31.(1) The Authority may,on application by a licensee,renew a licenceforafurtherperiodprovidedfor in subsection(3).
- (2)An application under this section shall
- (a)bemade in the prescribed form and forwarded to theAuthority togetherwiththeprescribedfee;
- b belodgedwiththeAuthorityatleastthree monthspriorto theexpiryofthelicence;and
- be consideredin accordancewith theprovisions ofsection30.
(3)Agamblinglicence issuedunder thissection shall bevalidforaperiodoftwelvemonthsfromthedateof issueorforsuchotherperiodasmaybeprescribedin regulations.
32.(1)TheAuthoritymayrefuse tograntorrenewa licenceifitissatisfied that
- (a)the information contained in the application is false or untrue in any material particulars;
- b theapplicationdoesnotmeetanyofthe requirementsfor theissuanceorrenewalofa licence;or
- ? theapplication isnotinconformitywiththe obtainingpolicyregardinguseofanysoftware system asprescribed by the CabinetSecretaryin consultationwiththeAuthority andthe CommunicationsAuthorityofKenya.
(2)WheretheAuthorityrefusestograntorrenewa licence,it shall forthwith notify the applicant in the prescribedform statingthereasonforsuchrefusal.
(3)A person aggrieved by the decision of the Authorityunder this sectionmay,within twenty-one days from thedayofnotificationunder subsection(2)lodgean Renewalofa licence.

33.(1)The Authority may revoke a licence issued underthisAct-
- (a) wheretheholderisinbreachofanyofthe provisions ofthisAct;
- (b) whereitdiscoversthatalicenseemadea statement inconnectionwith the application which heknew tobefalse oruntrue;
- C where thegamblingbusinessis woundupor dissolved;or
- (d) if thelicensee is in breach of anycondition prescribedintheActandwhichisrequiredfor theissuance of a licence.
(2)WheretheAuthorityintendstorevokealicence under subsection(1),theAuthority shall serve thelicensee withthenoticeoftheintendedrevocationspecifying the groundsfor suchrevocationandrequire thelicensee to, withinfourteendaysofserviceofthenotice,givereasons whythelicenceshouldnotberevoked.
(3)Anoticeunder subsection(2)shallbe servednot less thantwenty-onedaysbeforethedateoftheintended revocationandshallspecifythegroundsforsuch revocation.
(4)Wherealicenseefails togivereasonswithinthe periodstated,thelicenceshall cease tobevalid.
(5)If reasons are furnished by the licensee,the Authority,as the case maybe,shall after considering such reasons-
- (a)decidewhether or not torevoke thelicence;or
- (b) callupon thelicensee toappearbeforeitona specified date tomake oral representations in supportofanywrittenrepresentationsmadeby thelicensee or to answer anyquestionswhich the Authority,as the case may be,regarding such written representations,thereafter the Authority shalldeterminewhetheror not torevoke the licence.

(6)Therevocationofa licenceshall notprejudice any liabilityorobligationincurredunderorinrelationtothe licencepriortoitsrevocation.
(7)The revocation of a licence shall take effect upon the expiryof the notice under subsection(3).
(8)A licenseewhoselicencehasbeenrevoked shall surrender thelicencetotheAuthorityandshallnot be eligibletoholdalicenceunderthisActforaperiodnot exceedingfiveyearswitheffectfromtheeffectivedateof therevocation.
(9)A person aggrieved by the decision of the Authorityunder this sectionmay appeal to the Committee withintwenty-onedayswitheffectfrom thedateupon whichsuch decisionwasconveyed toa licensee.
34.(1) TheAuthority may suspend a licence issued underthisActif theholderofthelicencecontravenesthe provisionsoftheActupongivingnoticeandgivingthe licensee anopportunity tobeheard.
(2)Theprocedure under section33 shall applywith the necessary modifications when the Authority is considering the suspensionofalicence.
(3)Where theAuthority suspendsa licenceunder subsection(1),it shallforthwithinform thepublic through anoticeintheGazette,andtwonewspapersofnationwide circulationoranymediaofnational coverage.
(4)Where alicenceceasestobe validunder subsection (1),the Authority shall inform the licensee in writingthedateuponwhichthelicencewassuspended.
(5)Thesuspensionofalicenceshallnotprejudice any liabilityorobligationincurredunderorinrelationtothe licenceprior to its suspension.
35.Thedurationofeverylicenceissuedunder thisAct shallvaryforeachgamblingandbettingactivitysubjectto the provisions of section31(3).
36.(1) Alicensee shall display thelicence issued under thisAct at a place thatisvisible to thepublic during theperiodofvalidityofthelicence.

(2)Wherethelicenceallowsfortheestablishmentofa branch,a copy of the licence shall be displayed at the branch at aplace thatisprominentlyvisibletothepublic duringtheperiodofvalidityofthelicence.
(3)A holder of an online gambling license shall displaythelicense issuedunder thisActin theironline platform.
37.(1)TheAuthoritymayfrom time to time andonits ownmotionoruponreceiptofinformationfromany person,investigate the conduct of a licensee under thisAct.
(2)The Authority may direct any person who is investigatedpursuant to subsection(l) to take such action asmay be necessary to rectifyany shortcomings discovered,and may take such other action as may be appropriatewhere thelicensee failsorrefuses tocomply withdirectionsissuedbytheAuthority.
38.TheAuthoritymay issue a duplicatelicence toa licenseewhoselicenceis lost,destroyedormutilatedupon applicationforaduplicateintheprescribedformand payment of theprescribedfees totheAuthority.
39.(1) The Authority shall keep andmaintaina registeroflicencesinsuchformasitmaydetermineand shallrecordintheregisterinrespectofeverylicence
- (a) the name,identity and registration number of a licensee;
- b) particularsofthegamblingactivity towhicha licence relates;
- ? the county orcountiestowhich alicencerelates;
- (d) the date of expiry of thelicence;
- (e) particulars ofanyrevocationorsuspensionof the licence;
- ( particulars ofany amendment to a licence;and
- (g) any other particulars that the Authority may consider necessary.
(2)TheregistermaintainedbytheAuthorityshall be opento thepublicatreasonabletimesanduponpaymentof theprescribedfee.
40.(1) The Authority shall require a licensee to Securityfor

- (2) The insurance security bond or bank guarantee depositedunder thissectionmaybeused bytheAuthority todefrayalicensee'sliability,whichmayarisefromthe licensed activity.
2. (3)TheAuthorityshallprescribe applicableinsurance securitybondorbankguaranteeforagamblingactivity prescribedunder section28(2)(r). 3. (4)The Cabinet Secretarymayby notice in the GazetterevisetheThirdSchedule.
41.(1)Eachlicenseeshallprovideproofofadequate gamblingcapital tosetupthelicensed operations.
(2) The Authority shall,in consultation with the CabinetSecretary,determineandpublishbynoticein the Gazettetheamountofcapitalforeachgamblingactivity regulated under thisAct.
42.(1) The Authority shall prescribe books of accountstobekeptbyalicensee.
(2)A licensee shall regularly enter or cause to be enteredparticularsofentriesonthebooksofaccounts as prescribed by theAuthority.
43.(1)Alicensee shall submit to the Authority auditedstatementofaccountswithin threemonthsafterthe end ofafinancialyear.
- (2)The accounts ofa licensee submittedunder this sectionshallbeauditedbyanauditorapprovedbythe Authority.
- 44.Alicensee shall ensure that their gambling machines-
- a arelocatedinpremisesinwhich therespective county government hasissued a permit;
- b) aresourcedfromacertifiedsourcewith internationalcertificationstandards;
- C have animportcertificateissuedbytheAuthority indicating the model and the functions of the machine;and
gambling activity.

45.(1)Aholderofagamblinglicenceissuedbythe Authorityundersection28shallapplyforatradepermit from therespective county government for a premise withinwhich thepersonintendsto carryoutthelicensed gamblingactivity.
(2)Anapplicationforagamblingpermitshallbein suchmanner asmaybeprescribed bytherespective county government and shall be accompanied by—
- (a)the fee prescribed by the respective county government;
- (b)alicenceissued bytheAuthority;and
- (c)such otherinformation as the county government mayconsidernecessaryforthedeterminationofthe application.
(3)Acountygovernmentshallgrantapermitupon determining thesuitabilityoftheintendedpremisesfor whichthe applicationismadeandconsideringthe requirements set out in subsection(2).
(4)Apermit issued under this Act shallnotbe transferable.
46.Apermit issued under thisAct shallstate the locationofthepremisetowhich itrelates,and shall be endorsedwithallconditionsimposed bytheAuthority and respective county government.
47.(1) A county government may revoke a permit issued under thisActwhere
- (a)the holder is in breach of any condition attached to thepermit;or
- b) theAuthorityhasrevokedalicenceofapermit holder.
(2)Whereacountygovernmentintends torevokea permit under subsection (1),the county government shall Applicationfora permit.

- (4)If the person furnishes reasons, the county government, shall after considering such reasons—
- (a)decidewhether or not to revoke the permit;or
- (b)call upon the permit holder to appear before it on aspecified date tomakeoralrepresentationsin supportofanywrittenrepresentationsmadeby the permitholder or to answer any questions which the county government mayhave, regarding the written representations,and thereafterthecountygovernment shalldetermine whetherornottorevokethepermit.
- (5)Therevocationofapermitshallnotprejudiceany liability orobligationincurred under orinrelationto the permitprior toitsrevocation.
- (6)Where a permit is revoked,under subsection (1), the countygovernmentshall servethepermitholderwitha noticeofrevocationofapermitintheprescribedform.
- (7)Anoticeunder subsection(2)shall be servednot less thantwenty-onedaysbeforethedateoftheintended revocation and shall specify the grounds for such revocation.
- (8)Therevocationofapermitshall takeeffectafter twenty-one daysupon expiry of anotice issued under this section(7).
- (9)Theholderofapermitthatisrevoked shall surrender thepermit to thecountygovernmentandshallnot beeligibletoholdapermitunderthisActforaperiodnot exceedingfiveyearswitheffectfromtheeffectivedateof therevocation.
- (10)Aperson aggrieved by the decision of the county government under this section may appeal to the
Committeewithintwenty-onedaysfromthedateofreceipt of the decision.
48.Every permit issued by thecountygovernment shallbevalidforaperiodoftwelvemonthsfromthedate ofissue unless a different duration has beenprescribed under thisAct.
49.A holder of a permit issued under this Act shall, duringtheperiodofitsvaliditydisplaythepermitwithin thebusinessorpremiseataplace thatisprominently visibletothepublic.
PARTV-CONTROLANDLICENSINGOF LOTTERIES
50.(1)TheAuthority shall issue a licence authorizing thepromotionandconductofapubliclotteryintendedto raise funds for charitable purposes which may include charitable activitiesfor-
- (a) social service;
- (b) public welfare;
- (c) reliefofdistress;
- (d)recreational purposes;
- (e)sporting purposes;
- (f) any otherpurpose thatmay be assigned to it by the Authority.
(2)Theauthorization bytheAuthorityunder subsection(l)shall be for public lotteries where the promotionandlotteryactivitiesareundertaken countrywide,across more than one county or through media.
(3) The county governments may licence the promotionandconductofapubliclotteryintendedtoraise funds for thecharitable activitiesset outin subsection(1), wherethepromotionandthelotteryactivitiesareconfined withintherespectivecounties.
(4)The license issued under sub-section (3) shall be foraperiodnotexceedingoneyear.
(5)The Cabinet Secretary shall in consultationwith theAuthority,set thepercentageof thegrossrevenueofa Duration ofa permit.

(7) The Authority shall grant a licence for the promotionofalotteryunder thissectiononlytoabody corporate.
(8)Apromoterofalotteryauthorizedunder this sectionwhodevotesproceedsofthelotterytoactivitiesnot permittedortoapurpose other thanexpensesandprizes permitted commits an offence and shall beliable upon convictiontoafinenot exceeding twentymillion shillings ortoimprisonmentforatermnotexceedingtwentyyears, ortoboth.
51.(1) The Authority or county government shall,in respect of any publiclottery,impose the conditions prescribedin theActorinregulations toensure thata lotteryispromotedandconductedefficientlyforthe purposeforwhich itisbeingpromoted.
(2)In conducting a public lottery under this Act,a promoter-
- a) maydeductoperating expenses not exceeding twentyper cent ofgrossproceedsof thelottery;
- b) shallprovideinsurancebond or bankguarantee for theconductofthelottery;
3. ? shall ensureproper and equitable distribution of the charitablefunds of thelottery; 4. ? shalltakereasonablemeasurestoensure thata purchaserofa ticketora chanceinalotteryis protected againstfraud;and 5. e shall takesuchstepsasitmaydeemnecessaryto ensure that any conditions imposed by the Authority arecompliedwith. 6. (3)In this section, the term"gross proceeds"means

52.(1) A county government may issue a licence authorizingpromotionofalotteryrelatingto ahorserace, promotedwithin or outsideKenya.
(2)TheAuthoritymay,inrespectofalotterytobe promoted and conducted in Kenya under this section, issue-
- (a)an on-the-coursepermit authorizing the promotion andconductof alotteryon acourse specified;or
- b) a licence authorizingthepromotionandconduct ofalotteryoffthecourse.
53.(1)A lotterymaybepromoted andconductedon behalfofa society establishedfor
- a) charitable purposes;
2. (b) participation in a sport, support of athletics,or cultural activities;or 3. (C) purposes for raisingmoneytobe applied for purposesofpublicgood andarenotforprivate gain or purposes of commercial undertaking.
(2)TheAuthoritymay,upontheissuanceofalicence under this section impose such conditions to themannerin whichapersonissuedwithalicencemayconduct the promotionand conductofalotteryunder this section, including-—
- (a) requiring apromoter tobeamemberofa society dulyauthorized to actassuch;
- (b) prohibitingthepaymentofremunerationtoa promoteroranypersonengagedbywayof businessoremployedinthepromoter's organizationin connectionwith thelottery;
- C cappingtheprizeofatickettotwentythousand shillings;
- (d) a ticketorchanceshallbesoldforapriceofat least twenty shillings;

- g capping theamountoftheproceedsappropriated for theprovision ofprizesnotto exceed one half ofthewholeproceeds;
- (h) requiringthepriceofeach ticketorachancetobe thesame on all thetickets;
- requiring everyticket,noticeofa lotterylawfully exhibited,distributedorpublishedtospecifythe name of thesociety sponsoring thelottery,the nameandaddressofthepromoterandthedateon whichthedraw,determinationoreventtowhich theprizewinnersareascertainedisexpectedto take place;
- prohibitingthedeliveryofaticketthroughpostto a person whoisnot a member of the society;
- k) prohibitingtheadmittanceofapersonto participateinalotteryexceptuponpaymentto thepromoterofthewholepriceoftheticketor chance;and
- requiringpayment for expenses or prizes out of proceeds of the lottery.
(3)Aperson,including a promoter of a lottery who contravenes any of the conditions setoutin subsection(2) commitsanoffenceandshallbeliableuponconvictiontoa finenotexceedingonemillionshillingsortoimprisonment foratermnot exceedingoneyear,ortoboth.
54.(1)TheAuthoritymayissuealicenceforalottery promoted and conducted as an incidentof entertainment countrywide,acrossmore than one county or through the media.
(2)A county government may issue a licence fora lotterypromotedandconductedasanincidentof Lotteryincidental toentertainment.

(3)TheAuthorityor a countygovernmentmay,upon the issuance of a licence under this section,impose such conditionsonthemannerinwhichaperson issuedwith a licence may conduct the lottery,including—

- b) requiringthattheresultofthelotteryisdeclared on thepremisesinwhich thelottery tookplace;
- requiringthatthefacilityprovidedfor participatingina lotteryorthe gambling entertainmentisnotheldforprivategain;
- (d) requiringthat aprizeina lotteryisinthecustody anddisposalofapromoterofalottery;
- (e) requiringthataticketorchanceinalotteryis issuedorallotteduponthereceiptofthefull price;
- directingthatthepriceofaticketorchanceshall be displayed on each ticket;
- g) prohibitingmoneyprizeinalottery;and
- (h) cappingthepriceofaticketorachancetonot more thanfifty shillings.
(4)This section shallapply to entertainments including bazaars,sales of work,fetes,dinners,dances, sporting or athletic eventslimited to one ormore days.
(5)Apersonwhocontravenesanyoftheconditions set outin subsection (3) commits an offence and,shall upon conviction,beliable toa fine not exceeding one million shillingsor toimprisonment for a termnot exceedingoneyear,ortoboth.
55.(1) The Authority mayissue a licence authorizing aperson to organize andmanage a lottery incidental toa sportorgame.
(2)Alicenceshallstatethelotteryincidental to the game or sport which a licensee may organize and manage.
(3)The Authority may,inrespectof alicenceissued Licensinglotteries incidental to sportsorgames.

- a) themannerinwhich apersonmayconducta sportorgamelottery;
2. (b) the hours during which the premisesmay be open; 3. (C) the suitability,condition and conduct of the premises; 4. (d) the protection of persons taking part in the gamble against fraud;
- e) measures to ensure responsible gambling;and
6. ( paymentofadmissionfeesforpersonsgambling in thepremises.
(4)Where an admission fee is charged under subsection(3)(f)itshallbesubjectto thepaymentof tax undertheEntertainmentTaxAct.
56.(1)TheAuthority may issue a licence for a private lottery.
(2)TheAuthoritymay,upon theissuanceofa licence person issued with a licence, including——
- a) requiring the net proceedsor part thereof of lotterytobedevotedtotheprovisionofprizesfor purchasers of ticketsor chances,or,in thecase of a lotterypromotedforthemembersofthesociety shall be devoted to thepurposes of the society;
- b) requiringanoticeoradvertisementofalottery to beexhibitedonapremiseor theclubofthe memberswhomthelotteryispromoted;
3. C requiring thepriceofeach ticketor a chance tobe the same on all the tickets; 4. d requiringeach ticket tobear thename and address ofapromoterofthelotteryandastatementofa person towhom thesaleofthe ticketsorchances is restricted; 5. e requiringaticketora chance tobeissued or allottedbyapromoterbywayofsaleupon receipt of a full price; 6. prohibiting thereturnofmoneyor anythingof

57.Apromoterandabeneficiaryofalotterypromoted orconductedunderthisActshallberequiredtosubmit auditedaccountsandmakereturnsinsuchformandwithin suchperiodas the Authorityor respectivecounty governmentmay specify.
PARTVI-CONTROLANDLICENSINGOF BETTING
- 58.The Authority may,in respect of bookmaking issue-
- a) an on-the-courselicence authorizingaperson to carryoutthebusinessofabookmakeratany authorizedracemeeting;
- (b) anoff-the-courselicence authorizing aperson to carryon thebusinessofabookmaker atany authorizedbettingpremises;
- C) a licence authorizing a person to carry on the businessasabookmakerofbothonandoffthe courserace;or
- (d)an online bookmakers licence.
- 59.(1) The Authority may issue any of the following licencesforeachtotalisator
- (a) an on-the-course licence authorizing aperson to operate a totalisator on specified a course;
- (b) an off-the-course licence authorizing aperson to operateatotalisatorataspecifiedbetting premise;or
- ? a licence authorizing a person tooperatea totalisatorbothon andoff thecourse.
- (2)A licence under this sectionmaybe issued in
Submissionof auditedaccounts andretumsin respecttoa lottery.

(4)In this section,"race day"means an approved day inwhich aracemeetingisheld.
60.(1) The Cabinet Secretary may,in consultation with the Authority,make rules for the operation of totalisators.
(2)Aholderofatotalisatorlicenceshallconducta totalisatoror abettingpool in accordancewithtotalisator rulesissuedbytheAuthority.
(3)The aggregateofreturnsby a holder ofa totalisator licenceorapersonwhohasmadeawinningbetonany event,or combination of events,shall notbe less than eighty-fiveper centof the totalamountpooledor such other amount,asmay be approved by the Authority,in respectofan eventorcombinationofevents.
(4)Aperson whoparticipates ina totalisator'sbet shall not-
- (a)bet upon theresult of ahorserace or any other race;
- b sellorofferforsale,orpurchasefromapersona ticketor card entitlingapurchaser oraholder thereoftoaninterestin theresultoftheworking ofatotalisator on ahorseraceoranyotherrace;
- ? makea contractorbargainofanykindtopay or toreceivemoney upon an event determined or to bedeterminedby theresultoftheworkingofa totalisator on ahorseraceor anyotherrace;
- (d) receiveorpermitreceiptofabettingtransaction inrespectofatotalisatorinrespectofahorse race or any otherrace after thestart of therace;
- e register ona totalisator after the startofahorse race or any other race any money received in respectoftherace;or

(6)Apersonwhocontravenes theprovisionsofthis section commits an offence and shall be liable upon conviction toa finenotexceedingonemillionshillingsor toimprisonmentforatermnotexceedingoneyear,or to both.
61.(1)TheAuthorityshall issueapromoter'slicence inrespecttoapoolbettingschemeauthorizingapromoter toprovide apool bettingschemewithinKenya.
(2)A licence issued under this section shall apply to onepoolbettingschemeatatime.
62.(1)Apromoterofaracemeetingwhointends to permitabookmakertocarryoutbookmakingatarace meetingshall uponpaymentoftheprescribedfees,apply to the Authority for therelevant licence in theprescribed form.
(2)TheAuthoritymay uponreceiptof an application under subsection (l),issue a licence authorizing bookmaking to takeplaceataracemeetingheldona racecourse on thedayspecifiedin thelicence.
(3)A licence issued under this section shall specify thenumberofracemeetingsthatmaybeheldonalicensed racecoursewithin a year.
(4)In this section,"racecourse"means an approved ground used or intendedfor usefor thepurpose of horse racing or a related race.
63.(l) A licensee shall ensure that their betting machines--
- (a) aresourcedfromacertifiedsourcewith international certificationstandards;
- b) have animportcertificateissuedby theAuthority indicatingthemodelandthefunctionsofthe machine;and

(4)A single betin a gamblingmachine shall bea minimum oftwentyshillingsonly.
PARTVII-CASINO,SLOTMACHINEAND OTHERFORMSOFGAMBLING
64.(1)Apersonmaybegrantedalicencetooperatea casinoandotherformsofgamblinguponmeetingthe requirementsset outinsection29.
(2)TheCabinetSecretarymayinconsultationwiththe Authority and theCouncilof Governors,makeregulations prescribing the number of casinos,amusement machines, slotmachinesandotherformsofgamblingthatmaybe operatedwithin thecounties.
(3)The CabinetSecretary shall consider thefollowing inmaking theregulations under subsection(2)—
- (a)the number andgeographic distributionof existinglicensedcasinos,slotmachinesandother forms ofgambling at the time;
- b thepresence of touristsinacounty;
- C the culturaland religious distribution of the residentsofeach county;
- (d) the incidence and socialconsequences of compulsiveand addictivegambling;
- e thepromotionof—
- (i)job creationwithin thegambling industry;
- (ii)diversityofownershipwithin thegambling industry;
- (ii)efficiencyofoperation in thegambling industry; and
Casinos and other formsof gambling.
(iv) competitionwithin thegamblingindustry.
(4)TheCabinet Secretaryshall,in consultation with the Authority,make regulations prescribing the places where gambling machines shall be placed including the distanceto——
- (a) )learning institutions;
- (b) religiousestablishment;and
- (c) residential areas.
- (5)A singlebetina casino machine shall beplayed for aminimum oftwentyshillings.
65.Alicenseeshall,inrespectofeachpremisewhere a casinoisoperatedallow theAuthorityoranyperson designatedbythe authorityinwritingto—
- (a) enter anylicensedpremiseorfacilitybelonging toorunderthecontrolofthelicenseefor purposes of inspection;
- b) examine or inspect any machine,document or datain alicensedpremisesorfacility,andmake copiesorextractsfromit;
- seize,for the purpose of examination,any information,machine,document or data,on the conduct ofa casino;
- (d) sealor otherwise secureanysuch premise, facility,machine,documentor datainthecasino where anoffencehasbeencommitted;
- e secure eavalidandenforceablewritten undertakingfrom apersoncontrollinga licensee in any way not to change,transfer,cede the controlofalicenceorinanywayencumberthe licence toanotherpersonwithout theconsentof the Authority;and
- takesuchstepsasmaybereasonablynecessaryto protect all gambling players.
- 66.The Authority shallensure that its officers are present in all casinos forpurposes ofensuring compliance withtheActandtheconditionsimposedbytheAuthority undertherelevantlicence.

PARTVIII-ONLINEGAMBLING
- 67.(1)A person who desires to operate, sell or Liensingof onlinegambling promote online gambling in Kenya,shall apply,in the prescribed form,fora licence fromtheAuthority for the following-—
- (a)an online bookmakers licence;
- (b) an online lotterylicence;or
- C) an online casinolicence.
- (2)A person making an application for an online gamblinglicenceunder subsection(1)shall submitto the Authority aproposedgambling control system,which shall bedulyconsideredbythe Authoritywithor without variation.
- (3)In granting a licence under this section,the Authority shallrequire an applicant to depositwith the Authoritysuchsecurity asprescribed under theAct.
- 68.(1)Apersonlicensed tocarry out an online gambling activityshall conduct theactivityundera gamblingcontrolsystem approvedbytheAuthority.
- (2)TheAuthority shallnot approvea systemunder subsection(1)unless thelicenseeprovidesfor
- (a) online security ofinformation;
- (b) safety andsecurity against criminal activities;
- (C) onlinepaymentsystem;
- (d) protection measures against under age gambling;
- (e) protectionmeasures against vulnerabilityin gambling;
- ( awareness and education;
- (g) responsible advertising;and
- (h) data protection measures ProtectionAct,2019.
- (3)TheAuthorityshallimposetherequirementofan approvedgamblingcontrolsystemasaconditionof the licence granted under subsection (l) which the licensee shallberequiredtocomplywith.

(4)Thefailureby thelicenseetocomplywiththe requirements of theapproved gambling controlsystem shall leadtorevocationofthelicenceandoffence.
(5)The Authorityshallestablish a framework to facilitate real time monitoring of casinos and online gambling activities,which shall be accessible for monitoringby theCommunicationsAuthorityofKenya and anyotherrelevantgovernmentagency.
(6)In order tofacilitatethereal timemonitoringof gambling,an operator shall berequired toprovide the Authoritywith-
- (a)theplatforms forparticipation which may,where applicable,include
- (i)allvisual and audio communication channels; or
- (ii)an onlinewebsiteplatform;
- (b) particularsof thechargestobeleviedbyan operator;
- (c) particularsandthelocationofserversofthe operator'ssystemtoshowhowaplayermaybe registered andderegisteredonthesystem;
- (d) particularsand thelocationofall otherservers;
- (e) a valid telecommunicationlicence;and
- any otherinformationrequiredby theAuthority.
(7)In the caseofmobileonlinegambling,lottery ora bettinglicence,particularsofnetwork connectivity with twolinkstomobileoperatorsshallbeprovidedtothe Authority.
(8)An operator shallmaintaina customer carecentre withinKenya tomonitor andrespond toissuesraisedby consumers.
69.An online gambling transaction shall commence whenaplayer'saccountisdebitedwithanamountofabet andshallconcludewhenaplayer'saccountiscreditedwith anamountofwinningsinthecaseofawinningbetorwhen aplayerlosesthegame.

70.(1)Where aplayer inan onlinegambling transactionwins a monetaryprize,alicensee shall within twodayscredittheamountto theplayer'saccount.
(2)Where aplayer wins a non-monetary prize,the licensee shall—
- (a)deliver theprize tothe playerwithinseven days; or
- b) notifytheplayerinwritingofanaddresswithin Kenyawhere theprizemaybecollected.
(3)If a non-monetary prize is not collectedwithin a periodofsixmonthsafter thewinnerhasbeennotifiedof theplacewhere theprizemaybe collected,a licenseemay dispose of theprizebypublicauction,or in a manner approvedby theAuthority.
(4)Theproceeds of saleunder subsection(3)may be usedtopayfor thecostofdisposalof theprize,andany remainderbedepositedin theFund.
(5)Anyclaim against a licensee for uncollectedprize shalllapseaftersixmonthsfromthedateofdeclarationof the winnings.
(6)Anoperatorshallrequireproofofageofmajority priortotheremittanceoftheprizetotheregisteredplayer.
71.(1)Aplayer in an online gambling activity shall notbetanamountoflessthantwentyshillingsina competition.
(2)The minimum amount set under subsection (1) shall beinclusiveofsuch savingcomponentfortheplayer asshall bedetermined bytheAuthorityinconsultationwith the CabinetSecretary.
(3)An operator whopermitsaperson to engagein an onlinegamblingactivityforanamountlessthanthe amountprescribedundersubsection(1)commitsanoffence andshalibeliableuponconviction to afineof not less than fivemillion shillingsor toimprisonmentfora term not exceedingfiveyears,ortoboth.

72.(l) A licensee shall not allow any person to participate as a player in an authorized game conducted by

(5)Wherea licensee becomes aware that a person has providedfalseinformation duringregistration,the licensee shall notregistersuchperson andwheresuch apersonhas already been registered,the licensee shall immediately cancel theperson'sregistration.
- (6)A licensee shall avail the following to aplayer
- (a) alltherules relatingtoauthorizedgames conducted by a licensee;and
- b) theparticularsofanyprocessingfeewhichmay beincurred bytheplayer.
(7)A licensee shall not induce,facilitate or aid a playertoplaceawagerorabetbyadvancingcredits,the useofcreditcardsormeetingthirdpartycostsincurredby a player:
Provided that thisprovisionshall not applytofreebets and bonusbets conductedin the ordinarycourse ofbusiness.
73.(1) A licensee shall establish and maintain a player'saccountforeachplayerwhoisregisteredbythe licensee.
(2)A licenseeshallcredit toanaccountestablished under subsection(1)inrespect of a registeredplayer all funds--
- (a) receivedbyalicenseefromoronbehalfofa player;or
- (b) owedbyalicensee totheplayer.
(3)A licensee shall not accept awagerfrom a player unless-
- (a)thereare adequate fundsin theplayer's account

- 74.(1)A licensee shallnot-
- a) providecredittoaplayeroronaplayer'saccount oractasanagentforacreditprovidertofacilitate the provision of credit to a player;
- (b) make an offer designed to induce personsto participate or increase their participation in licensed activities;
- C participate in arrangements forinducingpersons to gamble.
- (2)A person who breaches the provisions of subsection (l) commits an offence and is liable,on conviction,toafinenotexceedingfivemillion shillings or imprisonmentforatermnotexceedingfiveyears.
- (3)Nothing in this section shall be construed as limitinganoperatorfromofferingfreebetsandbonusbets in the ordinarycourse ofbusiness.
- 75.Alicenseeshall notdealwith anyamountstanding to thecreditofaplayer's accountexcept
- (a)todebittotheaccountawagermadebyaplayer or an amount asdirectedbyaplayerforpurposes ofa wager;
- b toremitfundsstandingtothecreditofanaccount ofaplayer at theplayer'srequest;or
- ()to paybank charges for deposits received and

(2)Anymoneyin a player's account,includingmoney intransitorintheprocessofbeingclearedshall atanytime be atleastequal totheaggregateamount standingtothe credit ofplayers2accounts held by a licensee:
Provided thatwherefunds standingtothecreditofa player'saccountfallsbelow theaggregatetotalofthe amountstandingto thecreditofaplayers'accounts,the licenseeshallmakegood theshortfall from thelicensee's ownmoneywithinaperiodofthirtydaysfromtheendof themonth inwhich the shortfall occurs.
- (3)A licensee holdinga player'sbankaccount shall--
- (a)not enforce or execute,any charge,write-off, set-offorotherclaimagainstaplayer's account;
- (b)not combine the accountwith anyother accountinrespectof anydebtowedtoitby a player;or
- (c)credit anyinterestpayableon aplayer's account,only to theplayer's account.
77.(1)Where a transactionhasnotbeenrecorded on a player'saccountforthreemonths,alicenseeshallremitthe balancein theaccount toaplayer.
(2)Where thewhereaboutsofaplayerremain unknownforaperiodoffiveyears,themoniesstandingto thecreditoftheplayer'saccountshallbepresumed abandoned andthelicenseeshallremitsuchmonies to the UnclaimedFinancialAssetsAuthority.

- (d) thegoodcausestheyimplementedaspartofthe license conditions.
79.(1)Agamblingoperatorbasedinaforeigncountry shallonlybeissuedwithanonlinegamblinglicencewhere the operator
- (a)is registered inKenya;
- (b) has aphysical addressregistered inKenya;
- (c) intendstocarryon theonlinegamblingbusiness in Kenya; and
- (d) meets therequirements prescribedbythe Authorityinregulations.
(2)Inaddition to therequirementsundersubsection (1),agamblingoperatorbasedinaforeigncountryshall be required toprovideitsauditedbooksofaccountsfor the immediatelyprecedingyear.
(3)Aforeignbasedgambling operatorwhoprovides onlinegamblingservices inKenyawithoutalicence commits an offence and shall,upon conviction—
- (a)in the case of a natural person,be liable to a fine not exceeding twomillion shillings or to imprisonmentforatermnotexceedingtwoyears, or toboth;or
- b in thecaseofa corporateperson,beliabletoa finenot exceedingfiftymillion shillings.

82.(1)A person may,subject to subsections (2) and (3),providefor amusementwith aprize
- (a) onapremisewhichapermitfortheprovisionof an amusementhas been granted by acounty governmentundertherelevantlaw;and
- b atapleasurefairconsistingwhollyormainlyof anamusementprovidedbytravellingshowmen heldonanydayoftheyearonthepremisesnot previously used in thatyear onmore than twentysevendaysfortheholdingofapleasurefair.
- (2)The following conditions shall be observed in connection with amusementsunder thissection—
- (a)the amountpaid by apersonforany one chance towinaprizeshallnotexceedfive thousand shillings;
- (b)t theaggregateamountissuedbywayofsaleofa chanceinadeterminationofawinnerofaprize shall not exceedfivemillion shillings;
- (c)thesaleofa chance and adeclarationofaresult

- (3)Whereanamusementwithaprize takes theform ofagameplayedbyuseofamachineplayedbyinsertion ofa coin or a token into a machine,the following conditionsshall apply-
- (a)a successful playermayreceive
- ? amoney prize not exceeding one million shillings;
- (ii)aprizeother thanmoneyofavaluenot exceedingfivemillion shillings;or
- (ii)a token ofa nominalvalue exchangeablefor aprizeother thanmoneyon thebasisofa prizeofavalueoraggregatevaluenot exceeding five million shillings or fora numberoftokensequaltoamaximum numberof tokenswhichmaybewonby any oneplayingofthegame;and
- (b)a player's success at the game shall not entitle a person to exchange any prize or token fora benefitotherthanthoseprovidedforunder paragraph (a).
- (4)Apersonwhobreaches the conditions specified in thissectioncommits anoffence and shall upon conviction beliabletoafinenotexceedingonemillionshillingsorto imprisonmentfora termnotexceedingoneyear,ortoboth.
- 83.(1) A county government may issue an amusement

(4)In this section,"amusement machine"means a machine,other than agamblingmachine
- a) whichisoperatedbytheinsertionofacoinor coinsor otherequivalentinto themachine;
- b) wherebyasuccessfulplayerneitherreceivesnor is offered anybenefitother than—
3. ? opportunityaffordedbytheautomaticaction ofthemachine toplaythegameagain withoutinsertionofa coin;or 4. (ii)thedeliverybythemachineofacoinorcoins ofavaluenot exceeding thatrequired in ordertoplaythegame once.
84.(1) The Authority may,issue a licence authorizing thepromotion and conductofprize competitions cutting acrossseveral counties.
(2)A county government may issue a licence authorizingthepromotionandconductof prize competitionsconfined to a county.
(3)Apersonwhopromotesoradvertisesanyprize licence issuedunder this section shall be subject to such conditions as shallbe prescribed in regulations by the Authority and county governments,and in every case,to thecondition thatnopersonunder the ageofeighteenyears shall play an amusementmachineunless in thepresence of, Authorizationof prize competitions.

85.(1) Aperson shall not,without a license issued by theAuthority,conductamediapromotionwithprizes.
(2)Aperson who undertakes media promotion in either electronic orprintmedia withprizeslicensed under thissectionshallbesubjecttotheconditionsprescribedby theAuthorityinregulations.
- (3)The conditionsreferred toin subsection(2) shall include-
(a)eligibility of participants;
(b)costs of participation;
(c)datesof thepromotion;
(d)prizes to be won;
(e)verification ofwinnings by theAuthority;
(fprocess of claimingprizeswon;and
(g)publication of prize awards.

- 87.(1)Aperson shallnot,without the approvalofthe Authority,promote the advertisement of agambling activity on electronicmedium or anyother formof communicationby——
- (a) holdinghimselfoutbyadvertisement,promotion, noticeorpublicplacardwith theaimofenticing

- (2)Agamblingadvertisementshall—
- (a)indicate the addictive nature of gambling;
- (b) notifyplayerstoplayresponsibly;
- (C) prohibit childrenfromplaying;
- (d) not use false,misleading or deceptive message likelyto create an erroneouspositiveimpression ofgambling;
- (e) notbefeaturedorbroadcastedontelevisionor radiobetweensixo'clockinthemorningand ten o'clock in the evening unless during alive sportingevent;
- ( notbeerectedonanadvertisementbillboardof closeproximity to a learning institution;and
- g) dedicate twentypercentofaired advertisement towardspromotionofresponsiblegambling.
- (3)The Cabinet Secretary may,in consultation with theAuthority,makeregulationsprovidingfor
- (a)the circumstances under which the national lotteryandlicensedgamblingactivitiesmaybe advertised;
- b) information thatis to appearin an advertisement;
- ()the places where,circumstances or manner in
- which signsrelating to anationallotteryor gambling activitymaybedisplayed;
- d conditions requiring advertisements about the gambling service authorised by the licence including-—
- (i) publication only to certain classes ofpersons;
- (ii) thecontent which may require specified wordstobeincludedin the advertisement;
- (iii) contentnottobeincludedin an advertisement;
- (iv)contentnottobepublishedincertain typesof publications ormedia;and
- (v) requirementforthecontentofthe advertisement tobeapprovedbythe Authority.
- (4)Apersonwho contravenes theprovisions of this section commits an offence and shall,on conviction,be liabletoafinenotexceedingtwentymillionshillingsorto imprisonmentfora'termnotexceedingtwentyyears,orto both.
PARTXI-THEGAMBLINGAPPEALSTRIBUNAL
- 88.(1)Thereisestablished abodytobeknownasthe GamblingAppealsTribunal.
- (2)The Tribunal shall consist of
- (a)a Chairperson appointed by the President from amongpersonsqualified tobejudgesof theHigh Court;
- (b)two persons appointed by the Judicial Service Commissionwho shallbeadvocatesoftheHigh Court;and
- (c)four persons appointed by the Cabinet Secretary from among personswho possess knowledge and experiencein mattersrelatingto gambling,business administration, risk management law enforcementstudies.
- (3)The Chairperson andmembersof theTribunal shall beappointedby the CabinetSecretarybynoticein the

- (4)Aperson shall beeligible for appointment as a memberoftheTribunalifthatperson-
- (a)meets the requirements of Chapter Six of the Constitution;
- (b)has a relevant bachelors'degree from a university recognized in Kenya;

- (d)is not a public officer;
- (e)hasnotatanytimewithin theprecedingfiveyears been an employeeof theAuthorityor theNational Lottery Board;

- (g)has notbeen adjudged bankrupt bya courtof competent jurisdiction;and
- (h)hasnotinthelasttwelvemonthsimmediately preceding the appointment,had direct or indirect personalor commercial interest in the sector regulatedunderthisAct.
- (5)TheChairpersonor amemberof theTribunal shall hold office—
- (a)in case of the Chairperson,for a term not exceedingthreeyearsandshallnotbeeligiblefor re-appointment;and
- in case ofa member,for a termnotexceeding threeyearsandshallbeeligibleforreappointmentforonefurthertermofthreeyears based onsatisfactoryperformance.
- (6)The members of the Tribunal,other than the Chairperson,shall serveonapart-timebasis.
- (7)The Chairperson or member of the Tribunal shall
ceasetoholdofficeifthatperson
- (a)resigns from office by notice in writing addressed to—
- (i)thePresident,in the case of the Chairperson; or
- (i)the Cabinet Secretary,in the case of a member;
- (b)becomes a public servant or an employee of the Authority or theNational LotteryBoard;
- (c)isabsentfrom three consecutivemeetingsof the TribunalwithoutthepermissionoftheChairperson;
- (d)isadjudgedbankrupt byacourt of competent jurisdiction;
- (e)isconvictedofa criminal offenceunder anylawand sentencedtoimprisonmentforatermexceedingsix monthswithout the optionofafine;
- (fis unable toperform the functions of the office by reasonofphysical ormentalinfirmity;or
- (g)isotherwiseunableorunfit todischargethe functionsoftheoffice.
- (8)A person appointed as the Chairperson ora memberoftheTribunal shall,beforeassumingoffice,take orsubscribetotheoathoraffirmationbeforetheChief Registrar of theJudiciary.
- (9)Thefunctions of the Tribunal shall be tohear and determine appeals, from the national or county governments,——
- a) against any decision of the Authority or the National LotteryBoard;
- b) regarding complaintsarisingoutof theoutcome ofagamblingtransaction;
2. regardingcomplaints sarisingoutofthe functionalityof gambling machinesand equipment;and 3. regardinganyothermatterasmaybeprescribed underthisActorreferredtoitbytheBoard.
(10) Save as expressly provided by this Act,the Tribunal shall regulateits ownprocedure.
(11)The Judicial Service Commission shallprovide secretariat services to the Tribunal andshall assignor appointsuchsecretaryandothersupportstaffasmaybe necessaryfor the Tribunal toeffectivelyperformits functions.
(12) The Cabinet Secretary shall prescribe,in regulations,theproceduresfortheoperationalizationofthe Tribunal.

89.The Chairperson and themembersof theTribunal shallbepaidsuchremunerationandallowanceasshall be determinedbytheCabinetSecretaryon theadviceofthe Salaries andRemuneration Commission.
90.Aperson aggrievedbyadecisionof theTribunal mayappeal totheHighCourtwithinfourteendaysfromthe dateofthedecisionoftheTribunal.

(3)Apanelconstitutedforanyproceedingsshallhave atleastthreemembers,oneofwhomshallbeanadvocate of theHigh Court.

92.Aperson who,being the owner or occupier of a licensedgamblingpremisesorelectronicsitewho—
- a) allowssuchpremisetobeusedforunlicensed gamblingactivities;
- b) aidsinthecarryingoutofunlicensed management of electronicgambling siteor unlicensedbetting activities;
3. ? announces,publishes,cause to be announced, causetobepublished,eitherorallyorbymeans ofanyprint,writing,design,sign,orotherwiser solicit any person tobetinanunlicensed gambling activity or site; 4. ? advances,furnishes,or receives money for the purpose of establishing or conducting unlicensed gamblingactivity;or 5. e opens,keeps,uses,causesorpermits theuseofa premise for carrying on an unauthorized lottery,
commitsanoffence andshall beliableuponconvictiontoa finenotexceedingonemillionshillingsortoimprisonment fora termnotexceedingoneyearorboth.

96.Alicensee whorefusesor fails tosubmit a statementofaccountswhenrequiredbytheAuthority,the respective countygovernmentor the Collector orsubmits a falseor misleading statement ofaccounts commits an offence and shall,upon conviction,be liable to a fine not exceedingonemillionshillingsor toimprisonmentfora termnotexceedingoneyear,ortoboth.
97.Apersonwhofailstopayalevyoranyfees prescribedunder thisActshallbeliabletopay to the AuthorityandCountyGovernmentalloutstandingamounts ofleviesorfeestogetherwithinterestthatwill accrue atthe rateprescribed bytheCabinetSecretaryinRegulations.
98.Apersonwhooperatesor conductsanyform of gamblingwithoutavalidlicencecommitsanoffenceand shall beliableuponconviction—
- (a)for a first offence,to a fine not exceeding three millionshillingsor toimprisonmentforaterm notexceedingthreeyearsortoboth;and
- (b) fora secondorsubsequentoffencetoafinenot exceeding five millionshillingsorto imprisonmentforatermnotexceedingfiveyears ortoboth.
99.A person who prints,publishes, or causes to be printedorpublishedan advertisementor anynoticerelating toanunauthorizedlottery,orrelatingtothesaleofaticket orchancein anysuchlotterycommits an offence,andshall beliableuponconviction toa finenotexceedingone million shillings,or to imprisonment for a term not Transferofa licencewithout theapprovalof the Authority.

- (i)any matter descriptive of the drawing or intendeddrawingofalotteryrelatingtoan unauthorizedlottery,whichisintendedto actasaninducement topersonsto participateinthelotteryorinotherlottery;
- P brings,orinvites anyperson to send,into Kenya for thepurposeofsale ordistribution ofaticket or advertisementof unauthorizedlottery;or
- e sendsorattemptstosendoutof Kenyaany valuable thingreceivedinrespectofthe saleor distribution,ora documentrecording the saleor distribution,or the identity of theholder,ofa ticketor chancein thelottery,

101.(1)A person who acts,facilitates or carries on businesscontraryto thetermsofalicenceissuedunder this Actcommitsanoffenceandshall beliableuponconviction toa fine not exceeding ten million shillings or to imprisonment for a term not exceeding ten years,or to both:
Provided that thissection shallnotapply to an employeeof Prohibition againstunlicensed bookmaking.

102.Apersonwhoinconnectionwithatotalisatorin respectofwhich alicencehasbeenissuedunder thisAct
- (a)receives or permits to be received a betting transactiononatotalisatorinrespectofahorse raceoranyotherraceafterthestartoftherace;
- (b) registerson thattotalisatorafter thestartofa horserace or otherrace anymoneysreceived in respectof thatrace;or
- ? takesintoaccountin thecalculationorpayment ofabettingtransactionwhichhasnotbeen registeredonthattotalisator,
commitsanoffenceandshall beliableuponconviction to a finenotexceedingonemillionshillingsortoimprisonment for a termnotexceeding oneyear,or toboth.
103.(1) A person shall not
- (a)promoteapoolbettingschemewithinKenyain contraventionofthetermsofalicenceissuedunder thisAct;or
- (b)promote,receiveornegotiatebetsonbehalfofa promoterofanunauthorizedpool bettingscheme.
(2)A person whocontravenes theprovisionsof subsection (1) commits an offence and shall be liable upon convictiontoafinenotexceedingonemillionshillingsor toimprisonmentfora termnotexceeding oneyear,or to both.

110.Apersonwhowhileplayingwith aninstrument ofgamblingorintakingpartinthestakesorwagersorin betting on the sides,or handsof those that areplayingorin wagering on the event of a gamble,sport,pastime or exercisethroughunlawfulmeanswinsfromanotherperson oronbehalfofanotherperson,asumofmoneyorvaluable thing commits,an offence and shall be liable upon convictiontoafinenotexceedingtwomillionshillingsor toimprisonmentforatermnotexceedingtwoyears,or to Unauthorized racing.

PARTXIII-MISCELLANEOUSPROVISIONS
112.(1)TheAuthority and thecountygovernment shall appointdulyqualifiedofficerstobeinspectorsof the Authority and county government,respectively for such areasunits as shall bespecified.
(2)An inspector appointedunder subsection (1) shall
- (a) monitorcompliancewith theprovisionsofthis Act;
- (b) monitortheoperationsofalllicensedgambling operations;
- examineequipmentanddevicesusedingambling andscrutinize recordsmaintainedin respectof the gambling activities;
- d) monitor thehandling andcountingofmoneyon casinopremises;
- e receiveandinvestigatecomplaintsfromgambling patrons,licensees or members of the public in relation togambling;
- ( assist in any manner where necessary in the detectionofoffencescommittedunderthisAct on allgamblingpremises;
- reporttotheBoardon theconductofgambling operations;and
- (h) perform such other functions asmay berequired underthisAct.

- requiretheowneroroccupierof thepremisesto rendersuch explanation orgive suchinformation relating to any betting transaction,lottery or gamblingasmaybereasonablyrequiredbyhim orherintheperformanceofhisorherduties.
(2)Apersonwhoresistshinders or obstructs aperson actinginpursuanceofanyoftheprovisionsofthissection or who on a requisition under subsection (1),withholds informationorgivesinformationknowingorhavingreason tobelievethattheinformationisfalseormisleading commits,an offence and shall beliableonconvictionto a finenot exceedingonemillion shillingsor toimprisonment for a termnotexceeding oneyear,or toboth.
114.WhereanoffenceunderthisActiscommittedby a bodycorporate,everypersonchargedwithor concerned oractingin,thecontrol ormanagementof theaffairs,or activitiesofsuchbodycorporate,commits thatoffence and shallbeliable tobepunishedaccordinglyunlessit is provedbysuchperson thattheoffencewasnotcommitted throughno actor omission,onhispart,he was not aware that theoffencewasbeingorwasintendedor abouttobe committed,orthathetookallreasonablestepstoprevent itscommission.

115.(1) A person who has recognized that their gamblingisharmful tohimself or herself,or givingrise to difficultiesinlimiting themoneyortimeorboth,spenton gambling,leadingtoadverseconsequencesforthatperson, others,orforthecommunity,mayvoluntarilyenteraselfexclusion agreement between himselfor herselfanda licenseetobeexcludedfromallgamblingestablishments and all controlledgames,includingonlinegamblingor any othergambling activitiesorprivileges.
(2)Aperson whoentersanagreement under subsection(l) shallnotifytheAuthorityofthe agreement.
(3) The Authority shall maintain a register of all notifications made under subsection (2) and shall notify all licenseesoftheself-exclusion agreement.
(4)Theholderofa licenceissuedunder this Act shall—
- (a) establish mechanisms to give effect to selfexclusion andtakeallreasonablestepstorefuse servicetoapersonwhoentersaself-exclusion agreementfromparticipatingingambling;
- b as soon aspracticable,take allreasonable steps to prevent any marketing material from being availed to a self-excluded customer;
- ? takesteps toremovethe name,contact informationandotherdetailsofaself-excluded personfromanymarketingdatabasesusedbythe licenseewithintwodaysofreceivingthe completedself-exclusionnotification;
- (d) close anycustomer accountsofanindividualwho hasentered aself-exclusion agreement andreturn anyfunds held in the customer account;and
- (e) putintoeffectproceduresdesignedto ensure that an individualwhohas self-excluded shall not gainaccessto thelicensee'sgamblingservices.
- (5)An operator whofails toimplementa selfexclusionrequestwithinsevendaysofreceiptofawritten notificationcommitsanoffenceandshallbeliableupon convictiontoafinenotexceedingonemillionshillingsor toimprisonmentfor a termnotexceedingoneyear,or to both.
(6)Despite theprovisionsof thissection,theCabinet Secretary shall prescriberegulations providing for the manner inwhich an affected person may petition the Authorityfortheapplicationoftheself-exclusion provisionsonavulnerablegambler.
116.(1)Where apersonissuedwith alicenceunder thisActisconvictedofanoffenceunder thisAct,thecourt may order forfeiture or cancellation of licence ora forfeitureoftheinsurancesecuritybondorbankguarantee providedbythelicensee,whereapplicable.
(2)Aperson whoselicenceiscancelled inpursuance ofanorderundersubsection(1)shall,bedisqualifiedfrom holding or obtaining a licence or a further licencefora periodoffiveyearsbeginningonthedateoftheconviction whichgaverisetotheorder:
Providedthat thecourt mayincludeintheorder a direction thattheperiodofdisqualificationshallbeshorterthanfive yearsasthecourtmayspecifywhereit appearstothecourt tobejustin all the circumstances.
- (3)Abookmaker,promoter ofa pool betting scheme, organizer or manager of licensed gamblingpremises,or a servantoragent,whoemploysinhisorherbusinessany personknown tohimorher tobedisqualifiedunder subsection(2) commits anoffence and shall beliable on conviction toafinenotexceedingonemillionshillingsor toimprisonmentforatermnotexceedingoneyear,or to both.
117. The police shall,in coordination with the Authorityandcountygovernmentshavepower toseize any illegal gambling,betting andlotterymachines.

119.(1) The Cabinet Secretary shall,in consultation withtheBoard,makeregulationsgenerallyfor thebetter carryingintoeffectofanyprovisionsunderthisAct.

(i) theformandmanner inwhichreturnsor statementsof accounts shall befurnished to the Authority; 10. proximity ofgambling premises and advertisements tolearninginstitutions; 11. k protection ofwinners;and 12. (1 guidelines for gambler exclusion mechanisms including self-exclusion,venue-initiated request for exclusion,court ordered exclusions and requestbyfamiliesorinitiatedparties. 13. (3)ForpurposesofArticle94(6)ofthe Constitution— 14. a thepurposeandobjectiveofthedelegationunder thissectionis toenable the CabinetSecretary to makeregulationsforbetter carryingintoeffect theprovisions ofthisAct; 15. b theauthorityoftheCabinetSecretarytomake regulationsunder this Act will belimited to bringinginto effect theprovisions of thisAct and fulfilmentoftheobjectivesspecifiedunder this
section; and
- the principles andstandardsapplicable to the rulesmadeunderthissectionarethosesetoutin theStatutoryInstrumentsAct,2013.

121.(l) For the purposes of this section "former Transitional Board"means the Betting Control and Licensing Board provisions. existingimmediatelybeforethecommencementofthisAct.
(2)Upon thecommencementofthis Act,allrights duties,obligations,assets and liabilities attaching to the formerBoardshallbeautomaticallyandfullytransferredto the Authority established under section 6,and any referencetotheformerBoardinanycontractordocument shall,for allpurposes,bedeemed tobeareferenceto the Boardestablishedundersection6ofthisAct.
(3)Apersonwhoimmediatelybeforethe commencementofthisActwasamemberoftheformer Board shall,upon the commencement of this Act,be deemedtobeamemberoftheBoardfor theunexpired periodoftheirterm.
(4)A person who was,immediately before the commencementofthisAct,an employeeofthe former Board shall,upon the commencement of this Act,be deemed tobeanemployeeof theAuthority,subjectto subsection (5).
(5)Despite subsection(4),all theemployees of the formerBoardshallupon thecommencementofthisActbe givenanoptiontoelecttoserveintheBoardorbe redeployedinthepublicservicewithinaperiodofone year.
(6)Withoutprejudicetosection120,theprovisionsof sections29A,44A,55Aand59BoftherepealedActshall continuetobeinforceuntilnewprovisionsareenacted.
122.(1) All gambling activities including casinos and onlinegamblingwhoselicenceswereissuedunder the repealedActshallremainvalidfortheperiodofthe Transition of licences and permits.

1.(1)TheBoard shall meetnot less thanfour timesin everyfinancialyearandnotmore thanfourmonthsshall elapsebetweenthedateofonemeetingandthedateofthe nextmeeting.
