ENACTEDbytheParliamentofKenya,asfollows-

Short title.

1. ThisActmaybecitedastheEarlyChildhood Education(Amendment)Act.2023.

Amendment ofsection 31ofCap 211B.

Amendment ofsection 38ofCap 211B.

Amendment ofsection 68ofCap 211B.

  • Section3loftheEarlyChildhoodEducationAct.in this Act referred to as"the principal Act"is amendedbyinserting thefollowingnewparagraph immediately afterparagraph(f)
  • (fa)discussandrecommendmeasuresfor the welfareofteachers.
  • 3.Section38oftheprincipal Actisamendedby insertingthefollowingnewsubsectionimmediately aftersubsection(2)
  • (2A)A County Government shall takeintoaccountthefollowingfactors when determining the remuneration payabletoanearlychildhoodeducation teacher—
  • (a)theminimum rate advised by the Salaries and Remuneration Commission;
  • (b)minimumwage;
  • (c)thequalification ofindividual teachers;and
  • (d)any otherrelevantfactor.
  • 4.Section 68oftheprincipal Act isamendedin subsection3(a)by inserting the following new (viii)—

(viiia)welfare ofteachers;

CONCERNED THAT many Kenyans are compelled to travel long distances to access this service,both for the initial application and for any subsequent applications making theprocess tedious,time-consuming,and costly;

todelays and inconsistencies,which may compromise the authenticity and integrityofaCertificateofGoodConduct;

coGNIZANT THAT theimportance ofintroducingan automated Good Conduct Certification system,includingtheutilizationofbiometricfingerprintverification throughthedeploymentofbiometrickits,willenhanceaccuracy,security,and expediencyinverifyingindividual'srecord;

NOwTHEREFoRE,the Senate resolvesthat the National PoliceService Commission,in collaboration with the Ministryof Interior and National Administrationto:

  • 1.developandimplementanautomatedGoodConductcertificationsystem designed to streamline the issuance,renewal,and verification of certificatesofgoodconduct;
  • 2.incorporate advancedtechnologiessuchasbiometricfingerprint recognition,data encryption,andsecure communication protocolsto ensuretheaccuracyofindividuals'records;
  • 3.establishdecentralizedservicepointsanddeploysmobileregistrationunits across counties to enhance accessibility,especiallyin remote areas;and
  • 4.scaleuppublicawarenessinitiativesinruralareasontheapplicationand renewalprocessfortheCertificateofGood Conduct.

26.MOTION-WELFARE OF INTERNS WORKING UNDER THE PUBLICSERVICE COMMISSION (PSC)

THAT, AWARE THAT,the Public Service Commission has provided Agencies for a period not exceeding one year pursuant to Guidelines on ManagementofthePublicServiceInternshipProgrammeofOctober,2019;

APPRECIATING THAT,since its inception,the internship programme in Kenya has been instrumental in providing practical experience to graduates,enhanced employability,offered networking opportunities and hason a number of occasionsledtofull-timejobstograduates;

CONCERNED THAT,internship opportunities are limited in number,skewed in distribution across governmentDepartments and Agencies,lackclearpathway topermanent employment,haveinadequateopportunitiesfor skill development duetotheshortdurationthattheyareofferedand thatthestipendoffered to PSCinternsisinsufficientwith an average stipend ranging fromKsh.15,ooo to Ksh.30,oo0 per monthwhich isnot sustainable especially tointernslivingin major citieslikeNairobi,Mombasaand Kisumuwhere the costof livingis too high;

NOwTHEREFoRE theSenate resolves that the CabinetSecretary for Public ServiceandHuman CapitalDevelopmentinconsultationwiththePublicService Commissionreviewsthe Guidelinesto thePublicServiceInternshipProgramme ofOctober,2019withaviewto:-

  • costofliving;and
  • 2.putinplacemechanisms topromote andreward innovationbyinterns.

27.MOTION-INSTALLATION OF CCTV CAMERAS IN ALL POLICE STATIONS, CELLS ANDPOLICEREPORTING DESKS

s andconditionsofserviceandotherreformsformembersoftheNationalPolice Service and KenyaPrison Servicerecommended adequate Governmentfunding for theNational Police Service tomodernize itsfacilities,equipmentand gear, ServiceofficersinordertoenabletheServicedischargeitsmandateefficiently and effectively;

CoGNIZANTTHATtheBillofRightsprovidesforprotectionofhumanrights, preventionofabuseandupholdingoftheruleoflawwithindetentionfacilities and police stations;

violations,abuse,unexplained injuries,and deaths in custody,as well as securitybreachesandescapesfrompolicecellsacross thecountry;

FURTHERCONCERNEDTHAT despite the recommendations by the Justice Maragataskforce,littleornoeffortshavebeenmadetoensuremodernizationof police cellsbyinstallation of Closed-CircuitTelevision(CCTV) camerasandpolice reportingdeskstherebyaffectingpublictrustandaccountabilityonwhat happenstopersonsinpolicecustody;

NOwTHEREFoRE,theSenateresolvesthattheNational Government,through theMinistryofInteriorandNationalAdministration:

  • 1.installsfunctional and tamper-proof CCTVcamerasinallpolicestations, cellsandpolicereportingdesks acrossthe country;
  • 2.ensuresthatallCCTVsystemsaremonitoredinreal-timeandthatfootage is securely stored and made accessible during investigations,judicial processes;and
  • 3.provides the necessary resources,technical support,and training tolaw enforcementofficersfortheeffectiveoperationandmaintenanceofCCTV systemsandcontinuousdigitizationof OccurrenceBookplatforms.

28.MOTION-PROVISIONOFIFMIS REPORTS FORCOUNTYGOVERNMENTS TO THE SENATE

THAT,AWAREthat,Article96oftheConstitutionprovidesthattheSenate represents the counties,and serves to protect theirinterests,determines the allocation of national revenue among counties, as provided in Article 217, and exercisesoversightovernationalrevenueallocatedtotheCountyGovernments;

FURTHERAWARE THAT,inthecaseof TheSenate,the Councilof Governors and6othersPetitionNo.24and27of2029(consolidated)2022KESCNo. 57(KLR),theSupremeCourtaffirmedthat theSenate'soversightauthority extentstobothnationallyallocatedandlocallygeneratedrevenue;

todatafromtheIFMISsystemfortherespectivecountiestheyrepresent,thus affectingeffectiveoversightofCountyGovernments;

FURTHER CONCERNED THAT,in some instances data and information presentedtotheSenatebytheAuditor-Generaland theControllerofBudgetare receivedandconsideredlateasaresultofthebacklogresultingintotoomuch informationnotgettingproperlyreviewedbySenators;

NOTING THAT,as a result ofunchecked financial information and systems, CountyGovernmentshavecontinuedtoaccumulatependingbillsresultingfrom unplanned expenditures,unaccountedforandinflatedcostofprojects;

NOWTHEREFoRE,theSenateresolves,thatthe CabinetSecretaryin chargeof theNationalTreasuryshallonamonthlybasisforwardtotheClerkoftheSenate allIFMIStransactions andreports for eachCountyGovernmentforonward transmission to therespective Senatorfor information on accountability and transparency,in order to strengthen theirconstitutionaloversightandpromote goodgovernanceinthemanagementofpublicfinances.
