The first one is that the Road Maintenance Levy Fund (RMLF) is in court. As such, it cannot be processed any further and therefore we cannot have it in the Bill. THAT the Senate adopts the report of the Standing Committee on Roads, Transport and Housing on a petition to the Senate by Mr. Francis Otieno regarding compensation for sugarcane crop damaged by the department of public works, roads, energy and transport in Pap/ Oriang’ in Siaya County.

Thank you, Madam Temporary Speaker. I have one Statement for myself, and if you will allow me, another for Sen. Lomenen. I can start with mine and then move to Sen. Lomenen’s.
STATUS OF HEALTH INFRASTRUCTURE AND SERVICE DELIVERY IN MARSABIT COUNTY
I rise pursuant to Standing Order No.53(1) to seek a Statement from the Standing Committee on Health on a matter of countywide concern regarding the status of health infrastructure and service delivery in Marsabit County.
Health services delivery in Marsabit County remains a matter of grave public concern particularly in relation to the functionality and sustainability of key health infrastructure that supports emergency and critical care. Despite significant investment made over the years through both county budgetary allocations and donor interventions, questions persist regarding the operational capacity and effectiveness of vital health facilities.
In the Statement, the Committee should address the following-
- Details of medical oxygen generation plants established across Marsabit County indicating the total number, the allocations whether they were purchased or donated, the procurement process followed and the total cost incurred by the County Government of Marsabit;
- Whether the oxygen plants have been commissioned and are currently functional and if not, provide reasons for non-commissioning or inactivity, including any technical, administrative or financial bottlenecks; (3) The number of Intensive Care Unit (ICU) beds available within the county, specifying their source of funding or the same, whether donor-funded, nationally supported or procured by the county government and confirm whether they are operational and adequately staffed;
- An updated inventory of ambulances in the county indicating their distribution by sub-county or health facility, functionality status, the number of ambulances out of service, reasons for downtime, duration of non-functionality and the cost associated with repair or replacement; and,
- Comprehensive data on the number of vulnerable persons assisted under the Social Health Authority (SHA), from its inception to date, disaggregated by ward, gender and category of vulnerability and also indicate the total annual financial burden this has placed on the County Government of Marsabit. Madam Temporary Speaker, if you will allow me, I move to the question by the Senator for Turkana County, my friend Sen. Lomenen.
DISPLACEMENT OF FAMILIES RESIDING ALONG THE SHORES OF LAKE TURKANA
Madam Temporary Speaker, I rise pursuant to Standing Order No.53(1) to seek a Statement from the Standing Committee on National Security, Defence and Foreign Relations on a matter of inter-county concern regarding the displacement of families residing along the shores of Lake Turkana in Turkana and Marsabit counties respectively, which is occasioned by the rising water levels.
The affected communities have lost their homes and access to schools, health centres and other essential social amenities that have been submerged by the rising water.
Additionally, there has been a surge in crocodile attacks as the animals are displaced from their traditional breeding and hunting zones. This has led to encroachment upon human settlements. Consequently, several fatalities have been reported and the affected families are living in distressing conditions without adequate support.
In the Statement, the Committee should address the following-
- The number of homes, schools, health centres and other essential social amenities in Turkana and Marsabit counties that have been submerged by the rising water levels in Lake Turkana;
- The nature and extent of support that has been provided to the affected residents by both the county governments of Turkana and Marsabit and the national Government;
- The action taken by the Kenya Wildlife Service to mitigate the surge in human wildlife conflict cases involving crocodiles and other displaced aquatic animals and also provide details on the number of people affected, as well as the status of their compensation; and,
- The long-term measures being considered or implemented to safeguard communities residing along the shores of Lake Turkana from future displacement and related risks. Thank you very much, Madam Temporary Speaker. That is the end of my statement and the statement for Turkana County.

DELAYED PAYMENT OF SALARIES TO VARIOUS STAFF IN THE COUNTY GOVERNMENT OF MACHAKOS
Madam Temporary Speaker, I rise pursuant to Standing Order No.53 (1) to seek a Statement from the Committee on Labour and Social Welfare regarding the unpaid salaries to designated senior support staff by the County Government of Machakos.
In the Statement, the Committee should address the following-
- Establish the cause of delay in payment of salaries to designated senior support staff working in the Solid Waste Revenue and Education Department by the County Government of Machakos for more than two years. State the total amount owed by the County Government in terms of salary and arrears and plans in place, if any, to ensure the staff are paid without any further delays;
- Table a report on the current employment status of the affected staff;
- State the action, if any, the Ministry of Labour and Social Protection is taking to safeguard the rights and welfare of staff working under the administration of county governments; and,
- The policy intervention and measures being implemented to ensure timely disbursement of salaries and other related benefits to staff in the County Government of Machakos. Sen. Agnes Kavindu Muthama MP, Senator, Machakos County. Thank you, Madam Temporary Speaker.

COMMUNICATION FROM THE CHAIR
VISIT TO THE SENATE BY MR. DAVID MANDUKU MICHAEL
Hon. Senators, I would like to acknowledge the presence in the Speaker's Gallery this afternoon of Mr. David Manduku Michael, who is in the Senate on a courtesy call to Sen. Okenyuri.
Hon. Senators, Mr. Manduku Michael is a multifaceted artist, life coach, environmental conservationist and a humanitarian. He recognised his innate talent in art and began harnessing his skills in painting, pencil drawings and soapstone carvings. He has used his artistic abilities since 2010 to inspire and mentor underprivileged youths, who have not had the opportunity to pursue higher education.
He is the founder of Precious Plastic Kisii, a groundbreaking enterprise that transforms plastic waste into valuable products. This youth-led initiative focuses on waste management training and sustainable solutions to combat plastic pollution. His efforts in environmental conservation earned him recognition as a community ambassador in 2018. He champions climate change awareness and supports sustainable projects such as boreholes drilling, protecting natural water springs and providing housing and livestock to needy families.
In our usual tradition of receiving and welcoming visitors to Parliament, I extend a warm welcome to him. On my own behalf, and on behalf of the Senate, I wish him a fruitful visit.

Madam Temporary Speaker, I wish to take this opportunity to welcome to the Senate, Daudi Manduku, a young man from Sameta Mokwerero Ward, in Bobasi Constituency, Kisii County. This young man has been making very good artistic products from soapstone, which I deem a strategic mineral from South Mugirango, Kisii. He has not only been making artistic products, but also exhibited innovation by transforming plastic waste into valuable products. As a result, he was specially recognised by the National Heroes Council, by being awarded for his works in the awardees, who are just considered and honoured by the President in our last national celebration.
Madam Temporary Speaker, as we celebrate him, I encourage Kenyan youth to make innovation their Deoxyribonucleic Acid (DNA), utilise their skills and contribute to providing solutions for issues in this country be it from fashion, digital art, design or technology. So, Kenyan youth have a potential. Michael up here, who has just visited us is a testament that the youth indeed have what it takes to transform our country.

Thank you, Madam Temporary Speaker, for giving me the opportunity to comment on the Statements.
I would like to comment on the three Statements that have been brought by the Hon. Senators, starting with the one by the Senator of Machakos, Sen. Agnes Muthama. It is unfortunate that we can have public officers working for county governments or the national Government, giving their services to the public, and it comes out that they have not been paid, and specifically, as stated by the Hon. Senator, for two years.
Madam Temporary Speaker, when the Committee looks at this case brought from Machakos County, we want to establish the status of these workers. Are they casual workers, workers on contract or permanent employees, and why should they work and then they are not paid? We cannot be happy about that kind of unlawful way of keeping staff, yet they are working in very key areas - on waste management, revenue and education. We know how the environment is sensitive in the current world. Why would these workers be working without pay?
Madam Temporary Speaker, how does the County Government of Machakos expect these workers to meet their family obligations? I know they have families, children going to school and they have to take care of many obligations. We must also be told who is behind this unlawful activity. All that must be brought out.
I support my sister, Sen. Kavindu. That should not only be restricted to Machakos, but to all county governments as well as the national Government.
I thank you, my sister, for bringing the plight of Machakos people to the Floor. Secondly, Madam Temporary Speaker, I support the Statement by the Senator for Turkana on the displacement of families along Lake Turkana. There are two environmental issues we are dealing with, which become disastrous in our lives. There is the issue of floods and the soon-after floods, where our communities deal with extreme drought. All these are disasters. I remember once in the House here, I brought a question to the Ministry on their preparedness for floods and droughts, which lead to loss of property, life and livelihoods, also disrupting the lives of our people.
I support this Statement because I also come from around Lake Victoria region and the other year when there were heavy rains, part of our county in Homa Bay, Sindo and around the Lake, there was a lot of disruption and destruction in the town of Sindo. There was mass loss of property and livelihoods. The only the way the Ministry can work
on this is to have a workplan on their preparedness in dealing with floods and drought because these are disasters that are anticipated throughout the year.
Madam Temporary Speaker, I also support the Statement by the Senator for Marsabit on health infrastructure and service delivery in Marsabit. We have over- emphasised on the issues of health in counties. In order to achieve Universal Health Coverage (UHC) in this country, the county and the national governments must collectively look at the issue of health infrastructure. Looking at UHC in our counties is not only limited to infrastructure, but counties must work on requisite personnel that are required to deliver health services in our counties. We must all look at all the basic health services that lead to basic curative and preventative services, including promotive services in our counties.
Health is so basic to our people that we will not relent until counties are able to provide adequate health services that our people require. The Kenyan people spoke and they were specific that they wanted health services brought to counties and closer to them because they know how health impacts on them.
As we talk about health infrastructure and services, we are looking at health in totality, right from---

All I am saying is that counties must not only stop at providing health in referral hospitals, but also go down to improve health services, including to the sub-counties, health centres and dispensaries.

Thank you, Madam Temporary Speaker, for giving me this opportunity to comment on the two statements by Sen. Chute and Sen. Lomenen.
I will comment on the disaster in Turkana, which has left many people homeless and children cannot access schools. This is the rainy season and they are out there. I call on the national Government and County Government of Turkana to run with speed and settle these people because there are emergency funds in both the national Government and county governments. Even if there is no other money from anywhere else, the two funds from the national Government and county government should have settled these people by now, even before the Senator for Turkana brought this Statement. Our governments must have humility and be considerate of their citizens.
Madam Temporary Speaker, I also wish to comment on the issue of wildlife- human conflict. This has been a serious challenge not only in this county, but also in other counties, especially Machakos. I have dealt with this conflict and compensation has only been given to some people from 2014 to 2019. From 2020 to date, they have not been compensated. They are suffering because their breadwinners have been murdered by crocodiles and hippopotamus. These people should be compensated, so that they can continue with their lives.
I am shocked by the case of one boy whose leg was cut by a hippopotamus. I have been requesting his compensation, so that he can buy an artificial leg and continue going to school. For almost two years now, I have not received any reply. Therefore, the Committee that will deal with this Statement must check across the counties where wildlife–human conflict is affecting people and ensure that compensation is done.

INSTALLATION OF CCTV CAMERAS IN ALL POLICE STATIONS, CELLS AND POLICE REPORTING DESKS
AWARE THAT Article 51 provides that a person who is detained, held in custody or imprisoned under the law, retains all the rights and fundamental freedoms in the Bill of Rights, except to the extent that any particular right or a fundamental freedom is clearly incompatible with the fact that the person is detained, held in custody or imprisoned;
FURTHER AWARE THAT the National taskforce on improvement of the terms and conditions of service and other reforms for members of the National Police Service and Kenya Prison Service recommended adequate Government funding for the National Police Service to modernize its facilities, equipment and gear, and enhance its logistical and technological capabilities for National Police Service officers in order to enable the Service discharge its mandate efficiently and effectively;
COGNIZANT THAT the Bill of Rights provides for protection of human rights, prevention of abuse and upholding of the rule of law within detention facilities and police stations;
CONCERNED THAT there has been increasing reports of human rights violations, abuse, unexplained injuries, and deaths in custody, as well as security breaches and escapes from police cells across the country;
FURTHER CONCERNED THAT despite the recommendations by the Justice Maraga task force, little or no efforts have been made to ensure modernization of police cells by installation of Closed-Circuit Television (CCTV) cameras and police reporting desks thereby affecting public trust and accountability on what happens to persons in police custody;
NOW THEREFORE, the Senate resolves that the National Government, through the Ministry of Interior and National Administration:
- installs functional and tamper-proof CCTV cameras in all police stations, cells and police reporting desks across the country;
- ensures that all CCTV systems are monitored in real-time and that footage is securely stored and made accessible during investigations, judicial processes; and
- provides the necessary resources, technical support, and training to law enforcement officers for the effective operation and maintenance of CCTV systems and continuous digitization of Occurrence Book platforms.
