STATUS OF INVESTIGATIONS INTO THE DISAPPEARANCE OF MESSRS DERRICK MURETI MURIUKI AND LAWRENCE MAWIRA NJERU

1. Could the Cabinet Secretary provide the status of investigations into the circumstances surrounding the mysterious disappearance of Mr. Derrick Mureti Muriuki of ID No.29847092 and Mr. Lawrence Mawira Njeru on 29th June 2022 while en-route to Nairobi from Kakuma, Turkana County while on board motor vehicle registration number KCZ 057W which was later found abandoned a few metres from Salgaa Police Station, reported at Salgaa Police Station vide O.B Number 18/30/06/2022 and at Kasarani Police Station vide O.B No. 97/30/7/2022 respectively?
2. Could the Cabinet Secretary provide the measures put in place to guarantee security for the immediate family members of the above-mentioned persons considering that they have been receiving threats on their lives since the mysterious disappearance of their loved ones?

ELECTRIC POWER CONNECTIVITY IN MARSABIT COUNTY

1. Could the Cabinet Secretary provide a status report on the electricity connectivity to public institutions and households in Marsabit County, indicating the percentage of the said connectivity to these facilities?
2. Could the Cabinet Secretary elaborate the plans put in place by the Ministry to ensure that Marsabit County is connected to electricity power through the national grid?
3. Could the Cabinet Secretary explain the causes of frequent power outages in Marsabit County and provide the steps taken by the Ministry to address the said outages?
4. Could the Cabinet Secretary explain whether Kenya Power and Lighting Company adheres to the due process of issuing power interruption notices in Marsabit County before the power outage occurs?

STATUS OF SEISMIC ACTIVITY IN LIMURU

1. Considering that Limuru Constituency borders the Great Rift Valley and its location is in close proximity to Naivasha and other areas with geothermal activity, including dormant volcanic mountains, could the Cabinet Secretary provide the seismic status of Limuru area and its surroundings as well as data on the frequency of earth tremors?
2. Could the Cabinet Secretary provide the measures that the Government has put in place to ensure the design and construction of critical infrastructure in earthquake-prone areas can withstand structural challenges related to tremors?
3. Could the Cabinet Secretary provide details and contacts of key institutions responsible for measuring, monitoring and reporting on such tremors, and indicate the country’s capacity to undertake such exercises?

ADOPTION OF SESSIONAL PAPER ON NATIONAL AGRICULTURAL POLICY

THAT, this House adopts Sessional Paper No. 2 of 2021 on the National Agricultural Policy, laid on the Table of the House on Tuesday, February 8, 2022.

REPORT OF THE WHOLE HOUSE ON THE COUNTY GOVERNMENTS ADDITIONAL ALLOCATIONS (NO.2) BILL

Hon. Members, before I proceed to put the Question for agreement with the Report of the Committee of the whole House on this particular Bill, I wish to state that my attention has been drawn to a certain procedural lapse that took place yesterday afternoon during consideration of the Bill at the Committee of the whole House stage. It is notable that the County Governments Additional Allocations (No.2) Bill and the Senate Bill No.4 of 2022 is a form of an Annual Appropriations Bill seeking to allocate certain conditional funds to specified county governments.

As such, it is a Money Bill. Hon. Members, Article 114 (2) and (3) of the Constitution with respect to money Motions provides:

“If in the opinion of the Speaker of the National Assembly a motion makes provision for a matter listed in the definition of “a money Bill”, the Assembly may proceed only in

1. In this Constitution, “a money Bill” means a Bill, other than a Bill specified in Article 218 that contains provisions dealing with:
2. taxes;
3. the imposition of charges on a public fund or variation or repeal of those charges;
4. the appropriation, receipt, custody, investment or issue of public money;
5. the raising or guaranteeing of any loan or its repayment; or
6. matters incidental to any of those matters.”

Hon. Members, from the above, it is observed that before the House proceeds with consideration of any Motion with monetary implications, the relevant Committee of the House, and in this case, the Budget and Appropriations Committee must make a recommendation after taking into account the views of the Cabinet Secretary for the National Treasury.

As contained in the Order Paper of yesterday afternoon, there were certain proposed amendments to the Bill which were subject to the provisions of Article 114 of the Constitution. The amendments which were proposed by the Member of Maara, Hon. Kareke Mbiuki CBS, sought to amend the First Schedule of the Bill to reallocate certain funds for the construction of county headquarters for five counties.

Instructively, Hon. Members, it is observed that during the Sitting, the Chairperson of the Budget and Appropriations Committee pronounced himself as there being an agreement from the Committee regarding the amendment. However, I have not received any evidence by way of either a committee report or correspondence to confirm that the consultations contemplated under Article 114 of the Constitution between the Committee and the National Treasury took place.

Indeed, the Report of the Committee on its consideration of this Bill, which was tabled in the House, recommended that the amendments proposed by the Member for Maara Constituency and others proposed by the National Treasury relating to the disbursement of court fees and fines to the counties should not be considered by the House. Hon. Members, the intention of actualizing Article 114 of the Constitution and the practice that started in the 11th Parliament is to avoid whimsical amendments on the Floor, especially amendments that touch on taxes and imposition of charges on a public fund, and the appropriation of public money given the possible far-reaching implications.

Additionally, it should further be noted that this Bill will be passed annually. As such, any matters that may have been left out can be revisited in the next Bill once the requisite consultations have taken place. As your Deputy Speaker, however, I am duty-bound to correct the errors that fly against the Constitution, our laws and the Standing Orders. Article 114 of the Constitution on limitations on the amendments proposed by the Member for Maara was not lifted before consideration of the Committee of the whole House yesterday. In this regard,

1. That, the Bill be recommitted to the Committee of the whole House immediately. That the Committee shall resume from the point before the amendments were considered, being the First Schedule of the Bill.
2. That, in future, the Clerks-at-the-Table must ensure that the provisions of Article 114 of the Constitution and the practice that was started in the 11th Parliament on actualising the provision are upheld when guiding the presidium on all money Bills. The House is accordingly guided. Thank you. Hon. Members, in view of that communication, we now move to Order No. 12.

Members who are standing all over, including Hon. Kaguchia – I know that as a first-timer, you may not be conversant with the rules of the House. A cardinal rule of this House is that when the Chairperson is upstanding and you hear his voice, you immediately sit down or you freeze wherever you are. He is a former Speaker of the County Assembly of Nyeri. Please, let us hear one another.

Yesterday we had a small procedural lapse as we conducted this business, and a Communication has already been made in that respect. Incidentally, I was presiding over the Committee of the whole House. I am sure that the Chairperson of the Budget and Appropriations Committee was also misled, on the basis of which we transacted business that would ordinarily have been transacted differently. We are reversing that process now. First Schedule

REPORT AND THIRD READING THE COUNTY GOVERNMENTS ADDITIONAL ALLOCATIONS (NO.2) BILL

1. is quite critical for our counties. Many counties across the nation are waiting for funds, especially those that relate to donor funding and counterpart funding from the Government of Kenya. As I indicated yesterday, about Ksh5 billion is from the Government of Kenya and close to Ksh17 billion comes from our development partners who fund critical programmes in the water and health sectors. Let me also take this opportunity to tell our governors – both those serving their second terms and those serving their first terms – that, in the past, we have seen a lot of wastage even with donor funds coming in to alleviate problems in healthcare and water. We are asking all our governors to ensure that these funds, which amount to almost Ksh23 billion, do not go to waste. I have seen a number of new governors doing a lot of good work, especially in rationalizing staff levels in their counties to make sure that their wage bills come down so that more funds being allocated to them by the national Government can go towards development expenditure. I especially note the new Governor of Kisii County, who is a former Member of Parliament. It speaks well of Members who have served in this House who move on to become governors. Since they have been appropriating money to the counties, they know the importance of ensuring prudence in utilization of public funds. I commend the Governor of Kisii and quite a number of other governors I have seen doing good work in rationalizing expenditures in their counties. I encourage others to follow suit. Recent incidents between governors and their assemblies have been quite disturbing. I would like to use this opportunity to plead with governors, especially first-time governors. I know that when you are addressed by the title ‘Your Excellency’, at times it tends to go into your heads and you do not listen to other leaders. You start belittling Members of County Assemblies (MCAs) who are the legislators in county assemblies. Let us also speak to our governors and ask them to borrow a leaf from our President who consults and continuously engages with Members of Parliament in our Parliamentary Group Meetings and even outside, like during the ‘Hustlers Fund’ launch yesterday. Our governors should borrow a leaf from the President and engage with their county assemblies, both formally and informally, so that we see a seamless flow of services to Kenyans without unnecessary squabbles as we have seen in a number of counties. We can already see smoke billowing in a few other counties. There might be trouble in a number of counties very soon due to the attitude of a number of governors. I do not want to get into the business of mentioning names. They all know themselves and they better shape up before they are shipped out by MCAs. Thank you, Hon. Deputy Speaker. I beg to second.
